Bald Eagle
•No human disturbance or construction activity within 0.5 mile of any active bald eagle nest from November 15 to July 31.Activity within 0.5 mile of bald eagle nest sites would be best conducted between August 15 and October 15.
•No surface occupancy or construction within 0.25 mile of any active bald eagle winter night roost site, where there is no direct line of sight to the roost, between December 1 and February 28 and within 0.5 mile of any active bald eagle winter night roost site, where there is a direct line of sight to the roost, between December 1 and February 28.
•No human disturbance within 0.5 mile of any active bald eagle winter roost site from November 15 to March 15 except for periodic visits such as oil maintenance and monitoring Maintenance and monitoring work within the buffer zone after development should be restricted to the period between 10:00 a.m. and 2:00 p.m.

| OGLA | Form: (02A) 2589624 11/15/2010 | Operator shall provide notice to COGCC (Bo Brown via e-mail at bo.brown@state.co.us) and CDOW (Celia Greenman via e-mail at celia.greenman@state.co.us) fourteen (14) days prior to mobilizing for construction activities. The notice will facilitate CDOW conducting surveys of bald eagle activity at the nearby nest sites and winter roost sites. If bald eagle activity is observed and documented, operations will be prohibited as described in the wildlife COAs. If no bald eagle activity is documented, operator may mobilize to the location and begin oil and gas activities. If at any time during the restricted period of operations, bald eagles become active in proximity to the location, operator will be permitted to complete their current phase of operations and demobilize; operator shall not be permitted to mobilize for or to conduct oil and gas activities beyond the scope of operation underway at the time of initial bald eagle activity, until such operations can be conducted outside the timing restrictions. |
| OGLA | Form: (02A) 2589624 11/15/2010 | If construction, drilling and/or completion activities are conducted during the timing restrictions as described in the previous conditions of approval, operator shall conduct a third party daily survey of bald eagle activity proximate to the location to verify the presence or absence of the birds. The survey shall be conducted during oil and gas activities at times when bald eagle activity is most likely to be observed. Results of the survey shall be reported to COGCC immediately if bald eagles become active in close proximity to the location and a summary report shall be provided within one month of completion of oil and gas activities conducted during the timing restrictions. |
