REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on February 18, 1983 at 9:00 A.M. in Room 110, State Centennial Building, Denver, Colorado, after giving Notice of Hearing as required by law, on the application of Burton/Hawks, Inc., for an order establishing 320-acre drilling and spacing units for the production of gas and associated hydrocarbons from the Middle Morrow Sand underlying Sections 16, 17 and 20, Township 19 South, Range 47 West, 6th P.M., which are contiguous to the spaced area of the Neenoshee Field, Kiowa County, Colorado, or in the alternative that the lands be included in the spaced area of the Neenoshee Field in which 640-acre drilling and spacing units have been established by Order No. 388-1.

FINDINGS

The Commission finds as follows:

1. Burton/hawks, Inc., as applicant herein, is an interested party in the subject matter of the above-referenced hearing.

2. Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

3. The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order. 4. Evidence presented at the hearing was insufficient to make a determination concerning the proper spacing of the area; therefore, the application should be denied.

ORDER

NOW, THEREFORE, IT IS ORDERED, that the application of Burton/Hawks, Inc., filed January 3, 1983 with the Commission, requesting 320-acre drilling and spacing units for the production of gas and associated hydrocarbons from the Middle Morrow Sand underlying certain lands in the Neenoshe Field, Kiowa County, Colorado is hereby denied.
