REPORT OF THE COMMISSION
This cause came on for hearing before the Commission on May 21, 1979 at 9:00 A.M., in Room 110, State Centennial Building, Denver, Colorado after giving Notice of Hearing as required by law, on the Commission's own motion to consider the rescinding of Order No. 298-1 for the Wishbone Field, Morgan County, Colorado.
FINDINGS
The Commission finds as follows:
1. Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.
2. The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.
3. On June 19, 1975, the Commission issued Order No. 298-1 which con-sidered Well No. 2 Peterson-Federal Land Bank, located in the SW/4SW/4 Section 3, Town-ship 1 North, Range 56 West, 6th P.M., as an exception to Rule 318 of the Rules and Regulations of the Commission, and in order to offset any advantage that the well may have over an offset well, the No. 44-4 Awmiller, located in the SE/4SE/4 Section 4, Town-ship 1 North, Range 56 West, 6th P.M., a restriction was placed on the well based on a monthly capacity test.
4. Since said Well No. 2 Peterson-Federal Land Bank and the offset well, No. 4-44 Awmiller are now marginal producers, and the objective of preventing damage to said offset well has been completed, Order No. 298-1 is no longer necessary and should be rescinded.
ORDER
NOW, THEREFORE, IT IS ORDERED, that Order No. 298-1 for the Wish-bone Field, Logan County, Colorado, is hereby rescinded.
