REPORT OF THE COMMISSION
This cause came on for hearing before the Commission on May 19, 1964, at 10 a.m. in Room 132, State Services Building, Denver, Colorado, after publication of Notice of Hearing and receipt of Waivers of Service, as required by law and the rules and regulations of the Commission, on the application of S. Hammonds and Blanco Oil Company for an order authorizing as an exception to the spacing pattern established by Order No. 166-1 for the Mesaverde formation, the location of their No. 27-1 Moran-Government Well drilled 1359 feet south of the north line and 959 feet east of the west line of Section 27, Township 10 South, Range 96 West of the 6th P.M., Mesa County, Colorado.
FINDINGS
The Commission finds as follows:
1. That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.
2. That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.
3. That Applicants drilled their No. 27-1 Moran-Government well 1359 feet south of the north line and 959 feet east of the west line of Section 27, Township 10 South, Range 96 West of the 6th P.M., Mesa County, Colorado, to a total depth of 7636 feet for the purpose of producing gas from the Dakota sand formation, but that said well was found to be not capable of producing gas in commercial quantities from said formation.
4. That because of the mountainous terrain and other topographic difficulties, Applicants were practically and economically prevented from arriving at a location for said well which would comply with provisions of Order No. 166-1 for the Mesaverde formation.
5. That testimony presented indicates that said well is capable of producing gas in commercial quantities from the Mesaverde formation, and that an exception to the spacing pattern established by Ordeer [sic] No. 166-1 should be allowed for said No. 27-1 Moran-Government well, and that said well should be accepted as the permitted gas well for the drilling unit comprised of Section 27, Township 10 South, Range 96 West, 6th P.M., Plateau Field, Mesa County, Colorado.
6. That no objection to Applicants’ request was presented.
ORDER
NOW, THEREFORE, IT IS ORDERED, that an exception to the established spacing pattern for the Mesaverde formation in the Plateau Field is hereby granted for the No. 27-1 Moran-Government well located 1359 feet south of the north line and 959 feet east of the west line of Section 27, Township 10 South, Range 96 West of the 6th P.M., Mesa County, Colorado, and said well shall be the permitted gas well for the drilling unit comprised of said Section 27.
