Waste BMPs Trash will be kept bagged or covered and will be removed from the location for disposal as domestic solid waste at an approved waste disposal facility. Containers will be labeled according to requirements of Rule 605.h. Unused material will be removed for reuse at another drilling site or returned to the vendor as a product and will not be stored on the location. Wastes will be stored in containers or on lined containment that are chosen for compatibility and checked for leaks or integrity problems.

Wildlife BMPs No operations will withdraw from or discharge into surface waters. Staging, refueling or chemical storage will not be within 500’ of the Ordinary High Water Mark of Timpas Creek. The operator will fence the location and install nets or other CPW-approved exclusion devices on cuttings pit. Operator will use an appropriate seed mix in consultation with the surface owner for reclamation. Operator will install a fence consistent with CPW and surface owner. Operators will conduct all vegetation removal necessary for Oil and Gas Operations outside of the nesting season for migratory birds (April 1 to August 31). If hazing or other exclusion measures are not implemented, Operators will conduct pre-construction nesting migratory bird surveys within the approved disturbance area prior to any vegetation removal during the nesting season. If active nests are located, Operators will provide work zone buffers around active nests. No pits will be on Location. No flowline or other underground utility associated with the Project will cross either a perennial stream or an aquatic HPH. All open-vent exhaust stacks on production equipment shall be designed to prevent entry by birds and bats and to discourage nesting or perching. All tanks and above ground facilities shall be equipped with structures or devices that discourage nesting of raptors and corvids.

Topsoil BMPs There shall be a silt fence or straw wattles installed on the northeastern, eastern and southeastern portions of the location to control run-on to the pad, and prevent any stormwater flow to runoff the pad uncontrolled. Culverts will be installed along the County Road as directed by Las Animas County. Rock rip-rap placed on both sides of the culvert, per Las Animas requirements at the entrance to the road from County Road 111.1. During wellpad construction topsoil should be piled no higher than 3 to 5 feet high and slopes of the stockpiles should not exceed 2:1 (horizontal:vertical) to minimize erosion potential and facilitate interim stabilization. Perimeter control measures such as sediment control logs, rock socks, straw bales, ditch and/or berm with sediment trap(s) or sand bags will be used around the base of unstabilized stockpiles or where there is potential for sediment to come in contact with run off and leave the site. Topsoil material will be placed on the west side of the cleared pad and will be approximately 818 CY. Topsoil stockpiled for more than six months will be seeded and mulched with a temporary grass cover or will be stabilized using structural and/or non-structural control measures. To negate surface disturbance 12” x 12” test pits will be dug in the middle-west and the southwest corners of the wellpad. The pits will be dug in a manner prior to wellpad construction so that will not require any compaction post construction. To prevent erosion, stockpiles will be tracked perpendicular to runoff direction.

Stormwater BMPs During production, an earthen containment berm/trench will be implemented around the perimeter of the location. A combination of wattles and silt fencing will be implemented around the perimeter of the site in downsloping areas prior to earth disturbing activities taking place. The wattles will be the primary control measure installed until the pad is constructed.

Fluid Leak Detection BMPs Daily audio, visual, and olfactory (AVO) inspection of all above ground facilities. Daily production monitoring. Approved Instrument Monitoring Method (AIMM) Inspections with “FLIR” technology Camera on a bi-monthly basis and at other times as needed and appropriate. Dust Utilize existing vegetation, trees slash or brush piles to cover disturbed areas not used for vehicle traffic. Application of fresh water during dry season. Interim Reclamation BMPs A seed mix will be approved by the surface owner and the Colorado Parks and Wildlife prior to interim reclamation. All earthwork for interim reclamation will be completed within six months of well completion or plugging. Reclamation will be completed in the fall if possible; after September 15 and prior to ground freezing. If spring seeding is necessary, seeding will be conducted after the frost leaves the ground and no later than May 15.
