Form received 3/14/2025 ECMC Returned the Form to draft on 4/22/2025 after meeting with Operator personnel the same day with the following comments: 1) "Operator has provided a list of wells and Spill IDs related to this facility; However, the timing and relationship are unclear. Operator shall ensure the WMP addresses the following: -Description of reuse/recycling Operations prior to and post construction of the 40,000 bbl Produced Water Recycle Tank including timeframes. -Provide a list of Wells and Location/Facility IDs that have received/returned/recycled produced water from this Facility since operations began; including the timeframe and volume received, volume returned and/or volume recycled for each well and Location/Facility ID, -Describe the type of fluids received (flowback/production), pre/post treatment, -Provide figures depicting the locations of existing and removed equipment (flowlines, pumps, filters, etc.) -Describe the treatment process and location(s) of treatment facilities for fluids. -Provide a list of all Spills IDs associated with the recycling/reuse of fluids relating to this location and/or relating to any associated equipment (on and off location) since operations began." 2) "A waste management plan (WMP) for the placement of the Mustang Recycle Tank is required per Rule 905.a.(3). Operator shall attach the WMP for reuse and recycling on the revised Form 4." 3) ""Per COA on Form 27s Doc #403908415: "On the subsequent Supplemental Form 27, Operator shall provide dates and locations for which the Modular Large Volume Tank described on Form 4 Doc #402476531 was operational." Operator shall address this COA via Form 4 instead of Form 27 as it relates to the Location and not the spill. For reference Operator stated on Form 4 Doc #402476531: “Noble respectfully requests permission to add a temporary MLVT to the D05-12 Multi. See attached the Operator's certification that the MLVT will be designed and implemented consistent with the June 13, 2014 COGCC MLVT policy. Vendor: ShaleStone Number & Size: We will set one (1) MLVT (67' Diameter, 20,000 bbl) on location Anticipated Time Frame on location: 4 Months Location/Placement: As depicted on Location Drawing”" ECMC received the revised Form on 4/28/2025. Operator has not addressed comments applied to the subject Form on 4/22/2025 prior to resubmission of the subject Form on 4/28/2025. All monitoring wells shall be constructed as permanent 2-inch diameter with the screen interval intersecting the shallow groundwater table taking into account seasonal groundwater table fluctuations and constructed in accordance with the State Engineer's Water Well Construction and Permitting Rules. Soil borings shall be advanced and monitoring wells be installed using a hollow stem auger and continuous sampling be completed with a 2" split spoon sampler.

ECMC approves the proposed monitoring well locations; however, ECMC is requiring additional monitoring wells. One monitoring well located north of the tank and treatment pad (in the general area between the "4780 and 4790" labels), and a monitoring well slightly northeast of the proposed monitoring well #3 (in the general area of the "Access Road Off" label).

Lighting on location is considered temporary and will be used during recompletion activities. Permanent lighting will not be installed and utilized during normal production operations. Temporary lighting will be directed downward, inward, and shielded towards location to avoid glare on public roads and Building Units within 1,000 feet. Lighting will be turned off when practical, i.e., no operations being conducted. On production facilities some lighting will be installed on timers; permanent lighting may be used when necessary.

Housekeeping will consist of neat and orderly storage of materials and fluids. Wastes will be temporarily stored in sealed containers and regularly collected and disposed of at offsite, suitable facilities. If spills occur prompt cleanup is required to minimize any commingling of waste materials with storm water runoff. Routine maintenance will be limited to fueling and lubrication of equipment. Drip pans will be used during routine fueling and maintenance to contain spills or leaks. Any waste product from maintenance will be containerized and transported offsite for disposal or recycling. There will be no major equipment overhauls conducted onsite. Equipment will be transported offsite for major overhauls. Cleanup of trash and discarded materials will be conducted at the end of each work day. Cleanup will consist of patrolling the roadway, access areas, and other work areas to pick up trash, scrap debris, other discarded materials, and any contaminated soil. These materials will be disposed of properly.

Noble shall employ practices for control of fugitive dust caused by their operations. Such practices shall include but are not limited to the use of speed restrictions, regular road maintenance, restriction of construction activity during high- wind days, and silica dust controls when handling sand used in hydraulic fracturing operations. Additional management practices such as road surfacing, wind breaks and barriers, or automation of wells to reduce truck traffic may also be used if technologically feasible and economically reasonable to minimize fugitive dust emissions.

1. A contiguous spray liner will be installed and will underlay the entire tank battery. The location of a partially buried cement water vault will be excavated prior to liner install. 2. A sized steel secondary containment ring will be installed surrounding the entire tank battery. Sand and gravel bedding will be installed to protect the liner prior to placing equipment in the containment area.

1. A 60 bbl cement water vault will be utilized to collect excess produced water from oil tanks. Produced water in the vault will be removed as needed and disposed of in an approved UIC disposal well. The cement water vault is one piece with no seams designed to minimize potential for leaks. All piping associated with the use of the water vault will be aboveground and visually inspected on a regular basis. 2. The partially buried cement water vault will be installed above the spray in liner.

The operator shall employ sand traps, surge vessels, separators, and tanks during flowback and cleanout operations to safely maximize resource recovery and minimize releases to accommodate green completions techniques. Operator will use an enclosed combustion device with a 98% design destruction efficiency for hydrocarbons. When commercial quantities of salable quality gas are achieved at each well, the gas shall be immediately directed to the sales line or wells will be shut in and gas conserved. If a sales line is unavailable or other conditions prevent placing the gas into a sales line, the operator shall not produce the wells without an approved variance per Rule 805.b.(3)C. The Rule 912 notice and approval requirements apply regardless of a variance from Rule 805.b.(3)C.
