Dear Deputy Director Cuthbertson:
COGCC Staff has conducted a detailed assessment of the below surface owner final reclamation variances per the 1001.c rule and have found that the requests are sufficient and recommends approval. Staff finds that, in their current form, they are protective of public, health, safety, welfare, and the environment, with the below conditions of approvals. Below is a summary of 3 locations for which Caerus is requesting a 1001.c variance.
Hill Loc#312501 - Plugged and Abandoned 6/22/2015 - Document #401667426
• Requesting a variance of select requirements of rule 1004.a. regarding access road, turnaround and re-contouring of the location.
COGCC Staff recommends approval.
Conditions of Approval:
COA #1 - All corrective actions identified on a field inspection report must be performed by the corrective action date as a condition of approval for this variance until final reclamation is passed.
COA #2 - Continue to monitor and manage the site for erosion, weed control & establishment of vegetation until final reclamation is passed.
COA #3 - On the location establish 80% vegetation cover of a reference area per the 1004 rules.
COA # 4 - Operator must pass final reclamation on the location and un-reclaimed road (Variance) no later than Fall 2021. This COA does not relieve the Operator of enforcement if they are not conducting proper, revegetation, weed, and stormwater management.

Conditions of Approval:
COA #1 - All corrective actions identified on a field inspection report must be performed by the corrective action date as a condition of approval for this variance until final reclamation is passed.
COA #2 - Continue to monitor and manage the site for erosion, revegetation, and noxious weed control until final reclamation is passed. Please be aware that there is no variance for rules relating to stormwater, hence any un-reclaimed cut slopes must be stabilized.
COA # 3 - Operator must pass final reclamation on the location and un-reclaimed road (Variance) no later than Fall 2021. This COA does not relieve the Operator of enforcement if they are not conducting proper, revegetation, weed, and stormwater management.

• Requesting a variance of select requirements of rule 1004.a. regarding access road, and portion of location.
COGCC Staff recommends approval.
Conditions of Approval:
COA #1 - All corrective actions identified on a field inspection report must be performed by the corrective action date as a condition of approval for this variance until final reclamation is passed.
COA #2 - Continue to monitor and manage the site for erosion, revegetation (no variance requested for the 80% vegetation cover standard on all areas except the graveled portion), and weed control until final reclamation is passed.
COA # 3 - Operator must pass final reclamation on the location and the un-reclaimed road (Variance) no later than Fall 2021. This
COA does not relieve the Operator of enforcement if they are not conducting proper, revegetation, weed, and stormwater management.
Staff believes there is no further action required by the Director unless you would like additional information or any action to occur on staff’s part. Please let us know if you would like Staff to set up additional communications with you on these variances within five days. If there is no communication from you Staff will finalize the variances.
