1. Injection is not authorized until approval of Subsequent Forms 31 and 33. 2. PRIOR TO PERFORMING OPERATIONS: Operator is required to contact COGCC to discuss Step Rate Test or Injectivity Test criteria for Maximum Surface Injection Pressure determination. Prior approval of Form 4 is required for step rate and injectivity tests. 3. For ALL NEW DRILL UNDERGROUND INJECTION WELLS a suite of open-hole Resistivity/Gamma Ray and Density/Neutron logs IS REQUIRED from Surface Casing shoe to TD. A PDF, TIFF, or PDS visual image and a LAS or DILS file version of each log is required. 4. For all new and converted Underground Injection Control wells a Cement Bond Log (CBL) is required on the cased portions of the hole from the bottom of the casing to the top of the next shallower casing string for all casing strings other than the Surface Casing. Only a PDF, TIFF, or PDS visual image is required. 5. Operator must provide all tops of formations encountered from surface to TD on the Form 5 when submitted.

Maximum Injection Volume entered here, 50,725,949 bbl, is for the EWS-4 well. The EWS-4A Maximum Injection Volume is 44,395,850 bbls. These volumes are confirmed in the individual Form 33s for these wells.

Within thirty (30) days of the commencement of injection operator is required to file a Form 5A-Completed Interval Report for both the EWS-4 and EWS-4A: a. Notifying COGCC of the initial injection date, and b. Updating COGCC on the status of the well and injection zone used for Form 7 reporting.

Operator is required to file a Form 4-Sundry Notice with analysis of injected water collected one year after the initial injection date for both the EWS-4 and EWS-4A. Minimum analyses are TDS, major cations, and major anions. Data must also be submitted to COGCC Database in Electronic Data Deliverable (EDD) format. After the initial 1-year analysis, the analysis shall be repeated at five (5) year intervals.

For both wells the maximum authorized daily injection rate shall be 10,000 bbl/day. Initial injection may begin at a daily rate of 5,000 bbl/day. After 30 days if there is no seismic activity greater than 2.5M Richter within 5 miles of the facility the daily rate may be increased to 7,500 bbl/day. Again, after 30 days if there is no seismic activity greater than 2.5M Richter within 5 miles of the facility then the daily rate may be increased to 10,000 bbl/day. For EWS-4 or EWS-4A if operator wishes to inject at a daily rate higher than 10,000 bbl/day they must contact COGCC and make an application via Form 4-Sundry Notice.

At both EWS-4 and EWS-4A operator is required to perform additional Mechanical Integrity Tests ("MITs") at five (5) year intervals starting from the first test date reported here. If the downhole well configuration is changed at any time a new MIT must be passed before the well is returned to injection. All injection well MITs must be witnessed by COGCC.

EWS 4 DJ Basin LLC is required to monitor for seismic activity in the EWS-4 and EWS-4A area. If the EWS-4 and EWS-4A area is not already monitored for seismic activity then EWS 4 DJ Basin LLC is required to install a seismometer. EWS 4 DJ Basin LLC will be responsible for maintenance of the seismometer. Data gathered by the seismometer will be made available to one or more third parties (such as the USGS, CU-Boulder, CSM, or CSU) for analysis.
