Operator agrees to: provide mitigation option 1, 2 or 3 (per the DJ Basin Horizontal Offset Policy) to mitigate the situation, ensure all applicable documentation is submitted based on the selected mitigation option chosen, and submit a Form 42 (“OTHER – AS SPECIFIED BY PERMIT CONDITION”) stating what appropriate mitigation occurred and that it has been completed, prior to the hydraulic stimulation of this well.

1) The flaring of natural gas shall be allowed in accordance with COGCC Rule 912 for the initial production test period. 2) Notify the local emergency dispatch or the local governmental designee of any natural gas flaring. 3) Submit updated (requests to flare) to COGCC on Form 4’s (Sundry Notices), which discuss whether or not any new gathering systems or increased development of the field have changed pipeline economics such that installation of a new pipeline would be an economically viable option in lieu of continued flaring. 4) The operator is required to obtain and maintain any required air permits from CDPHE. 5)The flare volumes shall be reported by Form 7.

1) Flaring of natural gas shall comply with COGCC Rule 912. 2) Metered flaring volumes must also be reported on the Operators Report of Monthly Operations, Form 7. 3) The operator is required to obtain and maintain any required air permits from CDPHE. 4) Operator will use an enclosed combustion device with a 98% design destruction efficiency for hydrocarbons. Wells are to be managed so that production volumes do not exceed combustor capacity. 5) Provide the local emergency dispatch or the local governmental designee prior notice of natural gas flaring by supplying them with the approved Sundry Notice and all attachments. If any changes are made regarding this Sundry or the flaring protocol, local government designee and emergency dispatch are to be notified prior to flaring when flaring can be reasonably anticipated, or as soon as possible, but in no event more than two (2) hours after the flaring occurs. 6) This approval is good until December 31, 2018.

ConocoPhillips Groundwater Monitoring Program ConocoPhillips has adopted the Colorado Oil and Gas Association (COGA) voluntary groundwater testing program to establish baseline groundwater quality conditions around new oil well locations in their leased area. The sampling program will allow the company (ConocoPhillips) to evaluate the groundwater conditions before drilling a well and also to monitor water quality afterward. The program will be in accordance with the guidance set forth in the Voluntary Baseline Groundwater Quality Sampling Program last updated on November 15, 2011. Under the sampling protocol, water samples would be collected from the two closest groundwater sources with reasonable access. The sample points, permitted or registered wells, would located within ½ mile of the proposed well surface location. Sampling will be conducted based on the landowner granting access to the well location and agreeing to have the laboratory analytical results submitted to COGCC for posting to a database viewable by the public. Samples will be analyzed for the constituents listed in Table 1 of the Groundwater Sampling and Analytical Program.
