Comment:Form 28 Received on 12/23/14. Pit Conversion to Form 28. In review stage. Not approved. AFischer 12/24/14 Financial Assurance ID: 20150062 ($300,000.00) AFischer 12/18/15 APPROVED 6/20/2016 with the following COAs: FINANCIAL ASSURANCE COAs: • A Financial Assurance of $300,000 has been provided (Surety ID: 20150062). The COGCC is currently having a third party review the closure of the facility and prepare an independent closure estimate. Should the independent estimate be greater than $300,000.00, the Operator shall provide the additional financial assurance within 45-days of notification of the short fall. • Financial assurance, based on re-evaluated cost of reclamation, closure and abandonment estimate, will be reviewed at five (5) year intervals over the life of the Facility; however, the COGCC reserves the right to review the financial assurance for adequacy on a more frequent basis. GENERAL SITE COAs: • Monitoring wells that are dry shall be abandoned in accordance with the State Engineers Office and documented to the COGCC. • Provide pipeline testing results as part of the annual report submittal. • Within 45-days of the Form 28 approval, submit to the COGCC Engineering Integrity Group a GIS map with information, (shape files) in a suitable format showing the location of flowlines, type of pipe used in each segment, monitor points, valve locations, booster pump locations (if any) from EnCana’s well sites in the Piceance Basin that will transport fluids to and from the N Parachute WF A15 506 waste management facility. Provide and update as part of the annual report. • A detail of all stormwater BPM maintenance shall be provided in the annual report. • Within 30-days of this Form 28 approval, comply with COAs that are outlined in the original Form 15 Pit Permit Facility ID: 428147 and Form 2A Document Number: 400230807. Specifically: COA 22 - After installation of the uppermost liner and prior to operating the pit, the synthetic liner(s) shall be tested by filling the pit with at least 4 feet of fresh water, measured from the base of the pit (not to exceed the 2-foot freeboard requirement). The operator shall monitor the pit for leaks for a period of 72 hours prior to commencing operations. Operator shall notify the COGCC Oil and Gas Location Assessment (OGLA) Specialist for Western Colorado (Dave Kubeczko; email dave.kubeczko@state.co.us) 48 hours prior to start of the hydrotest. Successful hydrotest results must be maintained by the operator for the life of the pit and provided to COGCC prior to using the pit. • The Operator submitted a Rule 502.b.(1) variance request to the requirement set forth in Rule 908.b.(5).D. Centralized facilities shall have a fire lane of at least ten (10) feet in width around the active treatment areas and within the perimeter fence. In addition, a buffer zone of at least ten (10) feet shall be maintained within the perimeter fire lane. If the variance is not granted, the Facility shall immediately be closed per Rule 908.g.
