CAUSE NO. 65

 

ORDER NO. 65-5        (Emergency)

 

REPORT OF THE COMMISSION

 

The Oil and Gas Conservation Commission of the State of Colorado has heretofore established forty-acre drilling and spacing units in the Atwood-East Field by its Order No. 65-1.  As a result of development activity subsequent to the issuance of said Order No. 65-1, the Commission issued Orders No. 65-3 and 65-4 extending the limits of the Atwood-East Field.  

FINDINGS

The Commission finds as follows:

1.      That the Commission has jurisdiction to promulgate the hereinafter prescribed order.

2.      That the order of this Commission establishing forty-acre drilling and spacing units in the Atwood-East Field and requiring the well for each unit to be located not less than 330 Feet from any property line, lease line, lot line or governmental quarter-quarter section line works a hardship on those operators who own leases on which the Platte River channel falls.

3.      That an emergency exists which requires immediate action and requires a modification of existing orders in the Atwood-East Field insofar as they pertain to the location of wells; and that an Emergency Order should be issued in accordance with the provisions of 100-6-7(3) of the Oil and Gas Conservation Act.

4.      That the present orders should be modified to allow an operator to move the location of a well to the nearest practicable location outside the river channel and within the same forty-acre tract when the prescribed location falls in the Platte River channel.

5.      That the Atwood-East Field, as used herein, is that area described as Sections 1 and 2, Township 6 North, Range 53 West; the SW/4 of Section 18, the W/2 of Section 19, the W/2 of Section 30, the W/2 of Section 31, Township 7 North, Range 52 West; and the SE/4 of Section 13, the S/2 of Section 23, and all of Sections 24, 25, 26, 35 and 36, Township 7 North, Range 53 West, 6th P.M., Logan County, Colorado.

ORDER

NOW, THEREFORE, IT IS ORDERED, that Orders No. 65-1, 65-3 and 65-4 are hereby modified to allow a change in location of a well to the nearest practicable location outside the river channel and within the same forty (40) acre tract when the prescribed location falls in the Platte River channel, provided that the owners proposing to drill a well file with the Commission a waiver, or consent, in writing, signed by the lease owner toward whom the well location is proposed to be moved, agreeing that said well maybe located at the point at which the owner proposes to drill the well.

IT IS FURTHER ORDERED, that this Order shall be effective [sic] fifteen (15) days, commencing February 1, 1958.
