REPORT OF THE COMMISSION
This cause came on for hearing before the Commission on March 18, 1958, at 10:00 A.M., in the Game Room, Albany Hotel, Denver, Colorado, after publication of Notice of Hearing as required by law on the application of the Monsanto Chemical Company covering unit operations in the Little Beaver-East Field, and upon the Commission's own motion to consider possible deletions and additions to the Little Beaver-East Field, Washington County, Colorado, as previously defined in Order No, 53-1, dated January 2, 1955.
FINDINGS
The Commission finds as follows:
1. That due notice of the time, place, and purpose of the hearing has been given in all respects as required by law.
2. That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed Order.
3. That on January 12, 1955, the Commission issued its Order No. 53-1 in Cause No. 53, Little Beaver-East, establishing forty (40) acre drilling and spacing units for the production of oil and gas from the "D" sand, common source of supply, and defining the area to be known as the Little Beaver-East Field, and that subsequent development reveals that certain changes in the field limits of said Little Beaver-East Field should be made as follows:

4. That the provisions of Order No. 53-1, as they pertain to the establishment of drilling and spacing units, and the location of the permitted wells thereon in the Little Beaver-East Field should be extended to include the additional area as set forth above.
5. That the operators have completed the process of unitizing the upper bench of the "D" sand formation of the Little Beaver-East Field, in accordance with the terms and provisions of the "Unit Agreement, Little Beaver-East Field, Washington County, Colorado," hereinafter referred to as the Unit Agreement, which was submitted by the Monsanto Chemical Company at a hearing before the Commission on March 18, 1958. Such unitized area is herein referred to as the Little Beaver-East Unit Area, and is composed of the "D" sand reservoir underlying the following lands in Washington County, Colorado, to-wit:

6. That said Unit Agreement is necessary to increase ultimate recovery of oil and gas from said Unit Area, and should therefore be approved as being in the public interest for conservation.
ORDER
NOW, THEREFORE, IT IS ORDERED, that the following rules and regulations shall apply hereafter to the lands set forth in this order, in addition to other applicable rules and regulations and orders of the Commission heretofore adopted and not in conflict herewith.
Rule 1. Field limits for the "D" sand, common source of supply in the Little Beaver-East Field, Washington County, Colorado, as previously defined in Order No. 53-1, are hereby revised and hereafter shall include the following lands:
South Half (S/2) Section 26; East Half South-east Quarter (E/2 SE/4) Section 27; all of Section 34 and North Half (N/2), Southwest Quarter (SW/4) Section Thirty-five (35) of Township One (1) South, Range Fifty-six (56) West of the 6th P.M. and Northwest Quarter (NW/4) Section Two (2), North Half (N/2), North Half South Half (N/2 S/2) Section Three (3) and Northeast Quarter (NE/4), North Half Southeast Quarter (N/2 SE/4) Section Four (4) of Township Two (2) South, Range Fifty-six (56) West of the 6th P.M., all in Washington County, Colorado.
Rule 2. Forty (40) acre drilling and spacing units shall be, and the same are hereby established, for the production of oil and gas from the "D" sand, common source of supply, underlying lands as described in Rule 1:
(a) The permitted well for each unit shall be located not less than Three Hundred Thirty (330) feet from any property line, lease line, or governmental quarter-quarter section line, and shall be located not less than One Thousand Three Hundred Twenty (1320) feet between wells on the same lease within any one governmental quarter section; and that a tolerance of One Hundred (100) feet in any direction from the prescribed location shall be permitted only where surface obstructions or hazards make it unduly hazardous or expensive to drill at the prescribed location.
Rule 3. The "Unit Agreement, Little Beaver-East Field, Washington County, Colorado, providing for unit development and operation of the upper bench of the “D” sand formation is hereby approved. The unit area herein referred to as the Little Beaver-East "D" sand unit area includes the following described lands in Washington County, Colorado, to-wit:
Southwest Quarter (SW/4), West Half Southeast Quarter (W/2 SE/4) of Section Twenty-six (26), East Half (E/2), East Half Southwest Quarter (E/2 SW/4) of Section Thirty-four (34), and the Northwest Quarter (NW/4), North Half Southwest Quarter (N/2 SW/4) of Section Thirty-five (35) [sic] Township One (1) South, Range Fifty-six (56) West; and the North Half (N/2) of Section Three (3); East Half Northeast Quarter (E/2 NE/4) of Section Four (4) of Township Two (2) South, Range Fifty-six (56) West of the 6th P.M., all in Washington County, Colorado.
IT IS FURTHER ORDERED, that the rules and regulations contained herein shall become effective forthwith.
IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend or repeal any and/or all of the above rules and regulations.
