CAUSE NO. 51

ORDER NO. 51-3

REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on February 21, 1961, at 10:00 a.m., in Room 227, State Services Building, Denver, Colorado, after publication of Notice of Hearing as required by law, on the application of the Stuarco Oil Company, Inc. for an order establishing a 320-acre drilling and spacing unit for the production of gas from the "D" and "J" sands, separate common sources of supply underlying the SW¼ of Section 25 and NW¼ of Section 36, Township 11 North, Range 53 West, 6th P.M., Logan County, Colorado; and providing that no more than one well be drilled to or produced from the same common source of supply on this drilling unit.

FINDINGS

The Commission finds as follows:

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3.      That within the 320 acres sought to be spaced, the testimony as presented at the hearing indicates that the "J" sand reservoir is limited as to areal extent, and the "D" sand reservoir is limited due to water encroachment.

4.      That insufficient evidence was presented at the hearing in this matter to substantiate the application of Stuarco Oil Company, Inc. for a 320-acre drilling and spacing unit for the production of gas from the "D" and "J" sand formations underlying the SW¼ of Section 25 and the NW¼ of Section 36, Township 11 North, Range 53 West of the 6th P.M., Logan County, Colorado.

ORDER

NOW, THEREFORE, IT IS ORDERED, that the application of the Stuarco Oil Company, Inc. for establishment of a 320-acre drilling and spacing unit for the production of gas from the "D" and "J" sand formations underlying the Armstrong Field, Logan County, Colorado, is hereby denied.

ORDERED this 13th day of March 1961.
