REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on January 13, 1959, at 10 a.m., the Auditorium of the Department of Employment Building, Denver, Colorado, after publication of Notice of Hearing as required by law, on the application of James R. Jennings for an exception to Order No. 48-1, subsequently amended as to field limits, for a well to be drilled on the Center of the NW¼ SE¼ SW¼ of Section 4, Township 7 North, Range 55 West; and approval of said location or locations and the drilling thereof of Applicant's proposed well or wells in the SW¼ of said Section 4, so long as said location or locations shall consist of one well per quarter-quarter section and shall not fall closer than 600 feet from the outside boundary of the leasehold.

FINDINGS

The Commission finds as follows:

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3.      That exceptions should be granted for the drilling of wells in the SW¼ of Section 4, Township 7 North, Range 55 West of the 6th P.M., Logan County, Colorado, and that one (1) producible well should be permitted on each quarter-quarter section, such well to be located no closer than 600 feet to the boundaries of said quarter section; and that any such producible well should be the permitted well for the forty-acre drilling and spacing unit upon which it is located.

ORDER

NOW, THEREFORE, IT IS ORDERED, that exceptions are hereby granted for the drilling of wells in the Southwest Quarter (SW¼) of Section Four (4), Township Seven (7) North, Range Fifty-five (55) West, 6th P.M., Logan County, Colorado, with one (1) producible well to be permitted on each quarter-quarter section, such well to be located no closer than Six Hundred (600) feet to the boundaries of said quarter section, and such producible well, shall be the permitted well for the forty-acre drilling and spacing unit upon which it is located.
