REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on June 26, 1962, at 10 a.m., in Room 320E, State Capitol, Denver, Colorado, after publication of Notice of Hearing and receipt of appropriate waiver of service thereof, as required by law, on the application of the Pan American Petroleum Corporation for an exception to the spacing pattern established by Order No. 44-1, issued September 28, 1954.

FINDINGS

The Commission finds as follows:

1.      That due notice of the time place and purpose of the hearing has been given in all respects as required by law.

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3.      That Applicant has been unable to adequately deplete the "J" sand zone in the productive area which would normally be drained by the State of Colorado Well No. B-2 (NE¼ NW¼ Section 16, Township 3 South, Range 56 West) due to irreparable mechanical difficulties in the well bore in that zone.

4.      That to prevent waste and protect correlative rights, another well should be drilled and completed in the "J" sand for the production of oil at a location 150 feet west of the center of the NE¼ NW¼  of Section 16, Township 3 South, Range 56 West of the 6th P.M., Washington County, Colorado, and that said well should be the permitted well for the drilling unit upon which it is located; provided, however, that upon completion of said well, the Applicant will permanently plug and abandon the present State of Colorado Well No. B-2 in accordance with Commission rules and regulations.

ORDER

NOW, THEREFORE, IT IS ORDERED, that an exception to the spacing pattern established by Order No, 44-1 is hereby allowed for a well to be drilled in the "J" sand formation of the Big Beaver Field at a location 150 feet west of the center of the NE¼ NW¼ of Section 16, Township 3 South, Range 56 West of the 6th P.M., Washington County, Colorado, and that said well shall be the permitted well for the drilling unit upon which it is located; provided, however, that upon completion of said well, Applicant will permanently plug and abandon the present State of Colorado Well No. B-2 in accordance with Commission rules and regulations.
