REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on December 9, 1958, at 10:00 a.m., in the Game Room of the Albany Hotel, Denver, Colorado, after publication of Notice of Hearing and receipt of Waivers of Service thereof, as required by law, on the application of W.H. Sharp for exceptions to Order No. 41-1, for three wells to be drilled off the established spacing pattern, which application was amended by Applicant to change the location of one well from the C W½ SE¼ SW¼ to the C SW¼ SE¼ SW¼, Section 17, Township 9 North, Range 53 West, 6th P.M.

FINDINGS

The Commission finds as follows:

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3.      That exceptions to Order No. 41-1 should be allowed for three wells to be drilled on the following described locations:

1.	Center of the SW¼ NE¼ SW¼ of Section 17, Township 9 North, Range 53 West, 6th P.M.
2.	Center of the SW¼ SE¼ SW¼ of Section 17, Township 9 North, Range 53 West, 6th P.M.
3.	Center of the SW¼ SE¼ NW¼ of Section 17, Township 9 North, Range 53 West, 6th P.M.

and that said wells should be the permitted wells for the drilling and spacing units upon which they are located.

ORDER

NOW, THEREFORE, IT IS ORDERED, that exceptions are hereby granted for three wells to be drilled on the following described locations:

1.	Center of the Southwest Quarter of the Northeast Quarter of the Southwest Quarter (C SW¼ NE¼ SW¼) of Section Seventeen (17), Township Nine (9) North, Range Fifty-three (53) West, 6th P.M., Logan County Colorado;
2.	Center of the Southwest Quarter of the Southeast Quarter of the Southwest Quarter (C SW¼ SE¼ SW¼) of Section Seventeen (17), Township Nine (9) North, Range Fifty-three (53) West, 6th P.M., Logan County, Colorado;
3.	Center of the Southwest Quarter of the Southeast Quarter of the Northwest Quarter (C SW¼ SE¼ NW¼) of Section Seventeen (17), Township Nine (9) North, Range Fifty-three (53) West, 6th P.M., Logan County, Colorado,

and said wells shall be the permitted wells for the drilling and spacing units upon which they are located.
