IN THE MATTER OF THE INVESTIGATION TO TAKE MEASURES TO PREVENT WASTE OF OIL AND GAS IN THE MOUNT HOPE-NORTH FIELD, LOGAN COUNTY, COLORADO	) ) ) )	CAUSE NO. 41 ORDER NO. 41-4

REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on June 17, 1958, at 10 a.m., in Room 330 State Office Building, Denver, Colorado, after publication of Notice of Hearing and receipt of Waivers of Service, as required by law, on the application of A.T. Skaer for an exception to Order No. 41-1, for a well to be drilled off the established spacing pattern.

FINDINGS

The Commission finds as follows:

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3.      That an exception to Order No. 41-1 should be allowed for a well to be drilled on the following described location:

330 feet from the east section line, and 330 feet from the south section line, in the Southeast Quarter (SE¼) of Section Eighteen (18), Township Nine (9) North, Range Fifty-three (53) West of the 6th P.M., Logan County, Colorado,

and that said well should be the permitted well for the drilling and spacing unit upon which it is located; and that a tolerance of fifty (50) feet in any direction from such location should be permitted in the event surface obstructions or undue hazards are encountered.

ORDER

NOW, THEREFORE, IT IS ORDERED, that an exception is hereby granted for a well to be drilled Three Hundred Thirty (330) feet from the east section line, and Three Hundred Thirty (330) feet from the south section line, in the Southeast Quarter (SE¼) of Section Eighteen (18), Township Nine (9) North, Range Fifty-three (53) West of the 6th P.M., Logan County, Colorado, and that said well shall be the permitted well for the drilling and spacing unit upon which it is located; and that a tolerance of fifty (50) feet in any direction from such location shall be permitted in the event surface obstructions or undue hazards are encountered.
