CAUSE NO. 40

ORDER NO. 40-4

REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on September 17, 1963, at 10 a.m., in Room 132, State Services Building, Denver, Colorado, after publication of Notice of Hearing as required by law, on the application of W.C. McBride, Inc. for an order granting permission and authority to dually complete its R.W. Davis Well No. 1, located 600 feet north of the south line and 660 feet west of the east line of the SEĽNEĽ of Section 29, Township 9 North, Range 53 West, Logan County, Colorado, with production from the "J" and "0" sands to be separate and with no commingling in the well bore.

FINDINGS

The Commission finds as follows:

1.      That due notice of the time, place, and purpose of the hearing has been given in all respects, as required by law.

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3.      That Applicant is the owner and operator of oil and gas leases which cover, among other lands, the SEĽNEĽ of Section 29, Township 9 North, Range 53 West, 6th P.M., Logan County, Colorado, and has drilled its R. W. Davis Well #1 600 feet north of the south line and 660 feet west of the east line of the SEĽNE4 of said Section 29.

4.      That in the drilling of said well, the top of the "J"' sand formation was encountered at approximately 4946 feet and is capable of production of gas; and that the top of the "O" sand formation was encountered at approximately 5214 feet and is capable of production of oil.

5.      That the "J" sand reservoir, although potentially gas productive, has reserves sufficient only to justify its being used as fuel for production of the "O" sand oil.

6.      That Applicant proposes to perforate opposite the "J" sand formation between the approximate depths of 4956 feet and 4965 feet, and opposite the "O" sand formation between the approximate depths of 5259 feet and 5269 feet, and that said R. W. Davis Well No. 1 will then be capable of producing from both of these formations; and that quantities of such production will not justify single zone completions.

7.      That all available geological and engineering data concerning said well indicate that it can be dually completed as proposed by Applicant, with gas produced from the "J" sand formation and oil produced from the "O" sand formation produced independently and without commingling.

8.      That the granting of Applicant's request, and the completion and production of said well in the manner hereinabove described, will not result in waste, and that no damage will result to either formation because of such dual completion.

ORDER

NOW, THEREFORE, IT IS ORDERED, that W. C. McBride, Inc. is hereby granted permission and authority to dually complete its R. W. Davis Well No. 1, located 600 feet north of the south line and 660 feet west of the east line of the SEĽNEĽ of Section 29, Township 9 North, Range 53 West, 6th P.M., Logan County, Colorado, and produce gas from the "J" sand formation from perforations between the approximate depths of 4956 feet and 4965 feet; and produce oil from the *O" sand formation from perforations between the approximate depths of 5259 feet and 5269 feet, with no commingling of production from said "J*' and "O" sand formations.

IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend or repeal any and/or all of the above order.

ORDERED this 17th day of September 1963.
