ORDER NO. 38-2

 

REPORT OF THE COMMISSION

 

This Cause came on for hearing before the Commission on January 12, 1955, at 10:00 A.M., 704 State Capitol Annex, Denver, Colorado, after publication of Notice of Hearing as required by law, on the petition of Walter W. Miracle and R.M. Fifer, doing business as the Miracle-Fifer Drilling Company, for an exception to the spacing pattern established by Order No. 38-1.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place, and purpose of the hearing has been given in all respects, as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3.      That insufficient evidence was presented at the Hearing in this matter to substantiate the request of the Miracle-Fifer Drilling Company for an exception to Order No. 38-1, for a well to be drilled on the following described location:

 

Center of the Southwest Quarter of the Southeast Quarter of the Northwest Quarter (SW¼SE¼NW¼) of Section Ten (10), Town-ship 8 North, Range 53 West of the 6th P.M., Logan County, Colorado.

 

ORDER

 

IT IS THEREFORE ORDERED, that the application of Walter W. Miracle and R.M. Fifer, doing business as the Miracle-Fifer Drilling Company, for an exception to the spacing pattern established by Order No. 38-1, Divide Field, Logan County, Colorado, be denied.
