REPORT OF THE COMMISSION
This cause came on for hearing before the Commission on April 16, 1963, at 10 a.m., in Room 132, State Services Building, Denver, Colorado, after publication of Notice of Hearing and appropriate waiver of service thereof, on the application of the Skelly Oil Company for an order granting an exception to Order No. 34-2 for its C.V. Cogburn Well No. 1, previously drilled to the total depth of 5178 feet to test the Mississippi Lime, which formation was found to be non-productive. Applicant requests that said well be allowed as the permitted well for the Topeka-Lansing formation for the drilling unit on which it is located.
FINDINGS
The Commission finds as follows:
1. That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.
2. That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.
3. That Applicant has previously drilled its C.V. Cogburn Well No. 1 660 feet from the south section line and 660 feet from the west section line of Section 1, Township 33 South, Range 42 West, 6th P.M., Baca County, Colorado, for the purpose of testing the Mississippi Lime, which formation was found to be non-productive at the total depth of 5178 feet.
4. That Applicant tested the Topeka-Lansing formation, and completed said well as a gas well on March 17, 1963, with perforations between the interval 3090 - 3155 feet, with a plugged back total depth of 3258 feet.
5. That in order to prevent waste and avoid the drilling of an unnecessary well, said C.V. Cogburn Well No. 1 should be granted an exception to Order No. 34-2 so as to allow it to be the permitted well for the Topeka-Lansing formation for the drilling unit upon which it is located.
ORDER
NOW, THEREFORE, IT IS ORDERED, that an exception is hereby granted the Skelly Oil Company's C.V. Cogburn Well No. 1, located 660 feet from the south line and 660 feet from the west line of Section 1, Township 33 South, Range 42 West, 6th P.M., in the Greenwood Field, Baca County, Colorado; and that said well be the permitted well for the production of gas from the Topeka-Lansing formation for the drilling unit on which it is located.
ORDERED this 16th day of April 1963.
