REPORT OF THE COMMISSION
This cause came on for hearing before the Commission on July 21, 1959, at 10:00 a.m., in the Green Room of the Albany Hotel, Denver, Colorado, after publication and appropriate service of Notice of Hearing as required by law, on the application of the Frontier Refining Company for an order amending Order No, 34-2, to exclude a drilling and spacing unit described in said Order No. 34-2 as the S½ of Section 10, all of Section 15, and E½E½ of Section 16, Township 35 South, Range 41 West of the 6th P.M., Baca County, Colorado, from the Greenwood Gas Field; and further, that the Commission enter its order to (1) establish a gas field for the Topeka-Lansing formation covering the land in the drilling unit above described; (2) establish a single drilling unit for the gas field so established; and (3) provide that Applicant's No. 1 Colorado State-Holt well shall be the permitted well for the drilling unit as established; and should the Commission be unwilling to grant the orders prayed for above, then an order be entered allowing an exception to said Order No, 34-2, insofar as it governs the location of the permitted well in the subject drilling unit, and authorizing the existing well to be produced from the Topeka-Lansing formation as the permitted well for such drilling unit. The Commission also considered, on its own motion, the possible deletion of portions of the Greenwood Gas Field.
FINDINGS
The Commission finds as follows:
1. That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.
2, That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.
3. That Rule 2b(2) of Order No. 34-2, issued by the Commission on September 8, 1955, among other things, established the following defined drilling and spacing unit: S½ of Section 10, all of Section 15, and E½E½ of Section 16, Township 35 South, Range 41 West of the 6th P.M., Baca County Colorado; and further provided that the permitted well for the production of gas from the Topeka-Lansing formation on said unit should be located not less than. 1320 feet from the boundaries of such unit.
4. That the Frontier Refining Company drilled its No, 1 Colorado State-Holt well 750 feet south of the north line and 600 feet east of the west line of Section 15, Township 35 South, Range 41 West; and further, that the location of such well is 960 feet from the northwest corner of said Section 15, which corner is the closest point of said drilling and spacing unit boundary to the No. 1 Colorado State-Holt well.
5. That said No. 1 Colorado State-Holt well was drilled as a test to the Keyes formation, and located according to the best geologic and seismic information available to the Frontier Refining Company; and that upon testing, the Keyes formation was found to be non-productive; however, apparent commercial quantities of gas were found in the Topeka-Lansing formation, and said well was plugged back to 2908 feet opposite said Topeka-Lansing formation, and was completed as a shut-in gas well.
6. That according to all available engineering and geologic information, said drilling unit should remain in the Greenwood Gas Field; and, further, that an exception should be granted for the No, 1 Colorado State-Holt well as the permitted well for the production of gas from the Topeka-Lansing formation underlying the drilling and spacing unit upon which it is located and that the correlative rights of any interested parties in the Greenwood. Gas Field will not be adversely affected by the granting of such exception; and, further, that the granting of such exception is necessary to prevent the drilling of unnecessary wells.
7. That no evidence was presented which would justify the deletion, at the present time, of any portion of the Greenwood Gas Field, as defined by Order No. 34-2.
ORDER
NOW, THEREFORE, IT IS ORDERED, that an exception is hereby granted for the Frontier Refining Company's No, 1 Colorado State-Holt well located Seven Hundred Fifty (750) feet south of the north line and Six Hundred (600) feet east of the west line of Section Fifteen (15), Township Thirty-five (35) South, Range Forty-one (41) West of the 6th P.M., Baca County, Colorado, and that said well shall be the permitted well for the production of gas from the Topeka-Lansing formation underlying the drilling and spacing unit upon which it is located.
