This cause came on for hearing before the Commission at 10:00 a.m. on August 19, 2002, in Suite 801, 1120 Lincoln Street, Denver, Colorado on the application of Sandlin Oil Corporation for an order to remove certain lands from Order No. 34-1 and place the lands under the provisions of the Rules and Regulations of the Colorado Oil and Gas Conservation Commission.
FINDINGS
The Commission finds as follows:
1. Sandlin Oil Corporation (“Sandlin”), as applicant herein, is an interested party in the subject matter of the above-referenced hearing.
2. Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.
3. The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.
4. On July 14, 1954, the Commission issued Order No. 34-1, which, among other things, established 640-acre drilling and spacing units for the production of gas from the Topeka-Lansing Formation underlying lands in the Greenwood Field. By subsequent orders certain lands were added and deleted from the spaced area.

5. On December 20, 1983, the Commission issued Order No. 34-15, which established 320-acre drilling and spacing units for the production of gas from the Topeka-Lansing Formation for the below-listed lands in the Greenwood Field.

6. On June 27, 2002, Sandlin Oil Corporation, filed with the Commission a verified Application for an order to order to remove the below-listed lands from Order No. 34-1 and place the lands under the provisions of the Rules and Regulations of the Colorado Oil and Gas Conservation Commission. The applicant stated that the lands are separated from the Greenwood Field by dry holes and removal of the lands would be beneficial for future exploration for the production of gas from the Topeka-Lansing Formation.

7. Testimony and exhibits presented at the administrative hearing showed the spaced area to be vacated, the current spaced boundaries of the Greenwood Field and the boundary of the Greenwood Field as shown in geological publications.
8. Testimony and exhibits presented at the administrative hearing indicated that several dry holes in Sections 20 and 29 show the application area to be separated from the productive area of the Greenwood Field.
9. Testimony and exhibits presented at the administrative hearing showed that all surface owners and mineral owners in the application area were notified of the request to remove the lands from Order No. 34-1.
10. At the time of the administrative hearing, Sandlin Oil Corporation agreed to be bound
by an oral order of the Commission.
11. Based on the facts stated in the verified application, having received no protests and having been heard by the Hearing Officer who recommended approval, the Commission should approve an order to remove certain lands from Order No. 34-1 and place the lands under the provisions of the Rules and Regulations of the Colorado Oil and Gas Conservation Commission.
NOW, THEREFORE IT IS ORDERED that the Oil and Gas Conservation Commission issue an order to remove the below-listed lands from Order No. 34-1 and place the lands under the provisions of the Rules and Regulations of the Colorado Oil and Gas Conservation Commission.

IT IS FURTHER ORDERED, that the following lands shall remain subject to the provisions of Cause No. 34:
