IN THE MATTER OF THE PROMULGATION AND ESTABLISHMENT OF FIELD RULES TO GOVERN OPERATIONS IN THE BEECHER ISLAND FIELD, YUMA COUNTY, COLORADO Cause No. 300 Order No. 300-2

REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on August 17, 1976 at 9 A.M. in Room 1B-29, State Centennial Building, Denver, Colorado, after giving Notice of Hearing as required by law, on the application of Kansas-Nebraska Gas Company, Inc., for an order granting an exception to the spacing pattern as established by Order No. 300-1, Beecher Island Field, for two wells already drilled at locations not in accordance with the provisions of said Order.

FINDINGS

The Commission finds as follows:

1. That due notice of the time, place and purpose or the hearing has been given in all respects as required by law.

2. That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3. That on September 16, 1975, the Commission issued its Order No. 300-1 for the Beecher Island Field which established 640-acre drilling and spacing units for the production of gas from the Niobrara formation with the permitted well for each unit located no closer than 990 feet from the boundaries of said units.

4. That applicant drilled a well at a location 550 feet from the north line and 1150 feet from the east line Section 32, Township 2 South, Range 43 West, 6th P.M., and a well at a location 1040 feet from the north line and 800 feet from the east line Section 5, Township 3 South, Range 43 West, 6th P.M., and that said locations were inadvertently made, in compliance with the general rules and regulations or the Commis-sion, but not in compliance with the provisions of Order No. 300-1. 5. That said well, due to surface and topographical conditions, should be considered exceptions to Order No. 300-1 and be the permitted wells for the units upon which they are located.

6. That no objection to applicant's request was presented.

ORDER

NOW, THEREFORE, IT IS ORDERED, that an exception is hereby granted for a well drilled at a location 550 feet from the north line and 1150 feet from the east line Section 32, Township 2 South, Range 43 West, 6th P.M., and for a well drilled at a location 1040 feet from the north line and 800 feet from the east line, Section 5, Town-ship 3 South, Range 43 West, 6th P.M., Beecher Island Field, Yuma County, Colorado, and that said wells be the permitted wells for the units upon which they are located.

IT IS FURTHER ORDERED, that the above order shall become effective forthwith.
