REPORT OF THE COMMISSION
This cause came on for hearing before the Commission on January 20, 1976 at 9 A.M., in Room 532, State Services Building, Denver, Colorado, after giving Notice of Hearing as required by law, on the application of Ray H. Shivers for an order amending Order Nos. 262-2 and 232-8 to further restrict the production from Well No. I-A Appel, located in the SE/4 NW/4 of Section 29, Township 2 North, Range 66 West, 6th P.M.
FINDINGS
The Commission finds as follows:
1. That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.
2. That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.
3. That on September 4, 1975, the Commission issued its Order Nos. 262-2 and 232-8 which, among other things, restricted production on Well No. 1-A Appel located 2244 feet from the west line and 2050 feet from the north line of Section 29, Township 2 North, Range 66 West, 6th P.M., to 90% of the amount of oil the well is capable of producing as determined by production tests.
4. That based on the evidence presented at the hearing, the applicant did not sustain the burden of proof to show that, by the present restriction of production on said No. 1-A Appel well there is an abuse of correlative rights and that applicant is not receiving his just and equitable share of production from the Sussex formation underlying his land. Therefore, the application should be denied.
ORDER
NOW, THEREFORE, IT IS ORDERED, that the application of Ray H. Shivers, requesting that Order Nos. 262-2 and 232-8 be amended to further restrict production of oil from the Sussex formation in Well No. 1-A Appel, located 2244 feet from the west line and 2050 feet from the north line of Section 29, Township 2 North, Range 66 West, 6th P.M., is hereby denied.
