CAUSE NO. 26

ORDER NO. 26-53

REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on October 16, 1962, at 10 a.m., in Room 132, State Services Building, Denver, Colorado, after publication of Notice of Hearing as required by law, on the application of The Pure Oil Company requesting deletion of Rule 5 of Order No. 26-30, for the reason that the conditions which made the subject rule necessary no longer exist, and that the Adena "J" Sand Field has attained such a state of depletion that such rule can safely be deleted.

FINDINGS

The Commission finds as follows:

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3.      That on July 31, 1956, the Commission issued its Order No. 26-30 in Cause No. 26, which order included, among other things, the following rule:

"Rule 5.  No oil or gas shall be produced from wells with a producing gas-oil ratio of Ten Thousand (10,000) cubic feet per barrel of oil, or greater. All produced gas shall be metered within practical limits."

4.      That because of the present state of depletion of the Adena "J" Sand Field, said Rule 5 of Order No. 26-30 is no longer necessary and should be deleted.

ORDER

NOW, THEREFORE, IT IS ORDERED that Rule 5 of Order No. 26-30 in Cause No. 26, Adena "J" Sand Field, is hereby deleted.

IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend, or repeal the above order.

ORDERED this 16th day of October 1962.
