REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on September 15, 1959, at 10:00 a.m., on the Mezzanine of the Albany Hotel, Denver, Colorado, after publication of Notice of Hearing and receipt of Waivers of Service, as required by law, on the application of Petroleum, Incorporated for an order granting an exception to the "D" sand portion of the spacing pattern established by Order No. 26-1, issued January 19, 1954, which order was subsequently amended.  Order No. 26-16 enlarged the Adena Field limits to include Section 25, Township 1 North, Range 58 West, the area involved in said application. The exception requested by Applicant was for the Goedert No. 1 well, to be located in the center of the NW¼ NW¼ of said Section 25, instead of in the center of the SE¼ NW¼ NW¼, as now required.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3.      That an exception to the "D" sand portion of the spacing pattern established by Order No, 26-1, as amended, should be allowed for the Goedert No, 1 well to be located in the center of the NW¼ of Section 25, Township 1 North, Range 58 West, 6th P.M., Morgan County, Colorado, provided that in no event should said well encounter the "J" said formation and that said well should be the permitted "D" sand well for the drilling and spacing unit upon which it is located.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that an exception is hereby allowed for a well to be drilled in the center of the Northwest Quarter of the Northwest Quarter (NW¼ NW¼) of Section Twenty-five (25), Township One (1) North, Range Fifty-eight (58) West, 6th P.M. Morgan County, Colorado, provided that in no event shall said well encounter the "J" sand formation; and said well shall be the permitted "D" sand well for the drilling and spacing unit upon which it is located.
