IN THE MATTER OF THE PROMULGATION AND ESTABLISHMENT OF FIELD RULES TO GOVERN OPERATIONS IN THE FISH CREEK FIELD, ROUTT COUNTY, COLORADO Cause No. 258 Order No. 258-1

REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on September 19, 1972 at 9:00 A.M., in Room 132, State Services Building, Denver, Colorado, after giving Notice of Hearing as required by law, on the application of Benson-Montin-Greer Drilling Corporation, for an order approving a certain Unit Agreement and Unit Operating Agreement attached to said application as "Exhibit B" and "Exhibit C", respectively, for the development and operation of the Fish Creek Unit Area in any and all formations.

FINDINGS

The Commission finds as follows:

1. That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

2. That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3. That said Unit Agreement was approved by the United States Geological Survey and covers federal lands and leases as well as fee and State hands and leases.

4. That the unitized substances in and under the unitized land are defined by said agreement as all oil and gas in any and all formations, and that such unitized lands in Routt County, Colorado, are described in the following order.

5. That said Unit Agreement and Unit Operating Agreement are necessary for the development and operation of said Unit Area, and should therefore be approved as being in the public interest for conservation.

ORDER

NOW, THEREFORE, IT IS ORDERED, that the Fish Creek Unit Area, as set forth in the Unit Agreement entered into the 1st day of May 1969, is comprised of the following described lands in Routt County, Colorado:

Township 4 North, Range 86 West, 6th P.M. Section 7 through 10: All Section 15 through 23: All Section 26 through 35: All Township 4 North, Range 87 West, 6th P.M. Section 9 through 16: All Section 21 through 28: All Section 36: All Township 5 North, Range 86 West, 6th P.M. Section 5 through 8: All Section 17 through 21: All Section 28 through 34: All Township 5 North, Range 87 West, 6th P.M. Section 1 through 29: All Section 32 through 36: All Township 5 North, Range 88 West, 6th P.M. Section 1 through 12 All Township 6 North, Range 87 West, 6th P.M. Section 19: All Section 28: S/2 Section 29 through 34: All Township 6 North, Range 88 West, 6th P.M. Section 13 through 16: All Section 20 through 36: All

and said Unit Agreement and Unit Operating Agreement covering operations in any and all formations underlying said Unit Area are hereby approved pursuant to 100-6-16(1) CRS 1963, as amended, and subject to no waiver of the statutory authority of the Commission.

IT IS FURTHER ORDERED, that the CommiSsion expressly reserves its right, after notice and hearing, to alter, amend or repeal any and/or all of the above orders, rules and regulations.
