REPORT OF THE COMMISSION
This cause came on for hearing before the Commission on October 15, 1984 at 9:00 A.M., in Suite 380 Logan Tower Building, 1580 Logan Street, Denver, Colorado, after giving Notice of Hearing as required by law, on the application of William A. Sidewell, Jr., for an order restricting production from Well No. 2 Vondy located 330 feet from the south line and 330 feet from the east line (lot 4) Section 7, Township 2 South, Range 55 West, 6th P.M., alleging drainage and damage to applicants Well No. 1 Gilbert, located 990 feet from the north line and 990 feet from the west line (lot 1) Section 18, Township 2 South, Range 55 West and alleging abuse of correlative rights due to excessive production from said Well No. 2 Vondy.
FINDINGS
The Commission finds as follows:
1. William A. Sidwell, Jr., as applicant herein, is an interested party in the subject matter of the above-referenced hearing.
2. Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.
3. The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.
4. Following testimony taken in this the Commission did not approve the application by virtue of a tie vote.
ORDER
NOW, THEREFORE, IT IS ORDERED, that the application of William A. Sidwell, Jr. concerning the above-mentioned matter is not approved.
