ORDER NO. 230-5

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on September 20, 1982 in Room 110, State Centennial Building, Denver, Colorado, after giving Notice of Hearing, as required by law, on the application of Beren Corporation for an order exempting Well No. 4-27 Govt. from the provisions of the orders in Cause No. 230 for the Sooner Field.

 

FINDINGS

 

The Commission finds as follows:

 

1.      Beren Corporation, as applicant herein, is an interested party in the subject matter of the above-referenced hearing.

 

2.      Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

3.      The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

4.      On October 20, 1970, the Commission issued Order No. 230-1 which established 320-acre drilling and spacing units for the production of gas from the "D" Sand underlying certain lands in the Sooner Field.  Subsequent Order No. 230-4 restricted production to a maximum daily production of oil or gas from any one well in the spaced area producing from the "D" Sand, not to exceed 14 barrels of oil or 200 MCF of gas, whichever is first reached.  In addition, it was allowed that any new well drilled could produce a daily maximum of 50 barrels per day.

 

5.      Geological and engineering evidence presented at the hearing indicates the Well No. 4-27 Govt., located 660 feet from the north line and 860 feet from the east line Section 27, Township 8 North, Range 58 West, 6th P.M., penetrated a separate "D-2" Sand reservoir from that of the "D" Sand reservoir spaced by the orders in Cause No. 230 for the Sooner Field, and should therefore be exempt from the provisions of said orders.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that Well No. 4-27 Govt., located 660 feet from the north line and 860 feet from the east line, Section 27, Township 8 North, Range 58 West, 6th P.M., is hereby exempt from the provisions of the orders in Cause No. 230 for the Sooner Field, Weld County, Colorado.

 

IT IS FURTHER ORDERED, that the provisions contained in the above order shall become effective forthwith.
