ORDER NO. 21-9

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on May 24. 1960, 10:00 a.m., in Room 227, State Services Building, Denver, Colorado, after publication of Notice of Hearing and receipt of Waivers of Service, as required by law, on the application of Millard Huey and J. Ted Clark for an exception to Order No. 21-1, for a well to be drilled off the established spacing pattern.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3.      That an exception to Order No. 21-1 should be granted for a well to be drilled not less than 330 feet from the North line or less than 330 feet from the West line nor more than 660 feet from said lines of the NEž SEž of Section 27, Township 2 South, Range 57 West, 6th P.M., Adams County, Colorado, with a tolerance of 50 feet in any direction from such location in the event surface obstructions or undue hazards are encountered; however, if a commercial well is drilled on the location set forth above instead of on a location on as provided in said Order No. 21-1, the Commission should, at the request of interested persons, take such action as will offset any advantage which the person securing the exception may have over other producers by reason of the drilling of the well as an exception.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that an exception shall be granted for a well to be drilled not less than 330 feet from the North line or less than 330 feet from the West line nor more than 660 feet from said lines of the Northeast Quarter of the Southeast Quarter (NEžSEž) of Section Twenty-seven (27), Township Two (2) South, Range Fifty-seven (57) West, 6th P.M., Adams County, Colorado, with a tolerance of fifty feet in any direction from such location in the event surface obstructions or undue hazards are encountered; however, if a commercial well is drilled on the location set forth above, instead of on a location as provided in said Order No. 21-1, the Commission shall, at the request of interested persons, take such action as will offset any advantage which the person securing the exception may have over other producers by reason of the drilling of the well as an exception.
