REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on November 18, 1985 at 9:00 a.m., in Room 110 State Centennial Building, 1313 Sherman Street, Denver, Colorado, after giving Notice of Hearing as required by law, on the verified application of BHP Petroleum (Americas), Inc., for an order to rescind the field rules as established by Order No. 207-2 insofar as they govern operations for the production of oil from the Ft. Union formation underlying the NW1/4 Section 17 and the NE1/4 Section 18, Township 11 North, Range 97 West, 6th P.M., Powder Wash Field, Moffat County, Colorado.

 

FINDINGS

 

The Commission finds as follows:

 

1.      BHP Petroleum (Americas), Inc., as applicant herein, is an interested party in the subject matter of the above-referenced hearing.

 

2.      Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

3.      The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

4.      On January 16, 1968, the Commission authorized Order No. 207-2 to be issued which established 160-acre drilling and spacing units for production of oil and gas from the Ft. Union formation underlying Sections 16 thru 22, Township 11 North, Range 97 West, 6th P.M. in Moffat County, Colorado.  The units consist of a governmental quarter section with the permitted well located either in the center of the NE1/4 or the SW1/4 of the quarter section with a tolerance of 200 feet to avoid surface hazards.  Sections 27, 28 and the N1/2 Section 29 were added by Order No. 207-3 issued April 10, 1981.

 

5.      Based on the facts stated in the verified application and exhibits submitted and having received no objections, the matter was reviewed by the Director as hearing officer on November 15, 1985, and recommended to the Commission for approval.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that the provisions of Order No. 207-2 are hereby rescinded insofar as they govern operations for the production of oil from the Ft. Union formation underlying the following described lands in the Powder Wash Field, Moffat County, Colorado:

 

Township 11 North, Range 97 West, 6th P.M.

Section 17:

NW1/4

Section 18:

NE1/4

 

IT IS FURTHER ORDERED, that the provisions contained in the above order shall become effective forthwith.
