REPORT OF THE COMMISSION
This cause came on for hearing before the Commission on October 19, 1987 and was continued to November 16, 1987 at 9:00 a.m., in room 110 State Centennial Building, 1313 Sherman Street, Denver, Colorado after giving Notice of Hearing as required by law, on the Commission's own motion to consider re-installing Unit No. 5 as a 640-acre drilling and spacing unit for the production of gas and associated hydrocarbons from the Frontier formation underlying said unit.
FINDINGS
The Commission finds as follows:
1. Due to notice of the time, place and purpose of the hearing has been given in all respects as required by law.
2. The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.
3. On July 20, 1987, the Commission authorized Order No. 199-2 to be issued which rescinded Order No. 199-1 for all of the eleven 640-acre designated drilling and spacing units.
4. Testimony at the time of hearing indicated that the only well in the spaced area, located in the SE1/4 SE1/4 Section 9, Township 6 North, Range 91 West, 6th P.M. and the permitted well for the designated unit No. 5 is still capable of production and said unit No. 5 should not have been deleted from the provision of Order No. 199-1.
5. Order No. 199-2 should therefore be corrected and Unit No. 5, as described in the order herein, should be re-instated and continued to be subject to the provisions of Order No. 199-1.
ORDER
NOW, THEREFORE, IT IS ORDERED, that Order No. 199-2 is hereby corrected and the 640-acre drilling and spacing unit for the production of gas and associated hydrocarbons from the Frontier formation remaining in the Craig Field and subject to the provisions of Order No. 199-1 is described as follows:
