REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on June 18, 1974 at 9 A.M., in Room 132, State Services Building, Denver, Colorado, after giving Notice of Hearing as required by law on the application of Robert J. Beams, for an order to redelineate [sic] the drilling and spacing units as established by Order No. 197-1 for production of gas and associated hydrocarbons from the Topeka Limestone formation insofar as the same underlies Sections 1, 2, 12, 13 and 24, Township 31 South, Range 44 West; [sic] 6th P.M.

FINDINGS

The Commission finds as follows:

1. That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

2. That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3. That on June 14, 1966, the Commission issued its Order No. 197-1 which, among other things, established 640-acre, more or less, drilling and spacing units consisting of a governmental section, for the production of gas and associated hydrocarbons from the Topeka Limestone formation, with the permitted well to be located within a radius of 1200 feet of the center of each unit.

4. That the drilling and spacing units consisting of Sections 1, 2, 12, 13 and 24, Township 31 South, Range 44 West, 6th P.M., are unusually large and in order to conform more closely with the 640-acre drilling unit pattern in the Vilas Field, and to protect correlative rights, the 5 [sic] units in the area described above should be redelineated [sic] into eight (8) drilling and spacing units consisting of approximately 640-acres each. The permitted well for each unit should be located not less than 1320 feet from any boundary thereof and Well No. 1-24 Thompson located 660 feet from the south line and 3260 feet from the east line, Section 24, Township 31 South, Range 44 West, 6th P.M., and Well No, 1-12 Goodale, located 1980 feet from the east line and 1980 feet from the south line Section 12, Township 31 South, Range 44 West, 6th P.M., should be considered the permitted wells for the unit upon which each is located.

ORDER

NOW, THEREFORE, IT IS ORDERED, that the drilling and spacing units as established for the production of gas and associated hydrocarbons from the Topeka formation and consisting of Sections 1, 2, 12, 13 and 24, Township 31 South, Range 44 West, 6th P.M. shall be redelineated [sic] into designated drilling and spacing units described as follows:

IT IS FURTHER ORDERED, that the permitted well for each said designated drilling and spacing unit shall be located no closer than 1320 feet from any boundary thereof and Well No. 1-24 Thompson located 660 feet from the south line and 3260 feet from the east line, Section 24, Township 31 South, Range 44 West, 6th P.M., and Well No. 1-12 Goodale, located 1980 feet from the east line and 1980 feet from the south line Section 12, Township 31 South, Range 44 West, 6th P.M., shall be considered the permitted wells for the unit upon which each is located.

IT IS FURTHER ORDERED, that the provisions of this order shall become effective forthwith.

IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend or repeal any and/or all of the above orders.

CORRECTION OF ORDER

TO ALL INTERESTED PERSONS AND TO WHOM IT MAY CONCERN:

On June 18, 1974, the Commission issued its Order No. 197-4, which redelineated [sic] certain drilling and spacing units as established by Order 197-1. It has come to our attention that a correction should be made.

Section 12, S½ Lot 35 in the description of lands in Unit IV should be corrected to Section 12, S¼ Lot 35.
