REPORT OF THE COMMISSION
This cause came on for hearing before the Commission at 9:00 a.m. on January 10, 2005 in Suite 801, 1120 Lincoln Street, Denver, Colorado on the application of Bill Barrett Corporation (“BBC”) for an order to increase the number of wells which can be optionally drilled into and produced from the Williams Fork Formation of the Mesaverde Group which constitute existing drilling units (or portions thereof) to the equivalent of one Williams Fork Formation well per 10 acres for certain lands in Townships 6 and 7 South, Ranges 91 and 92 West, 6th P.M. BBC requested that wells be located downhole anywhere in the drilling and spacing unit but no closer than 100 feet from the boundaries of the unit without exception being granted by the Director. For lands that the Commission has not at the time of the drilling permit application granted the right to drill 10 acre density, the well should be located downhole no closer than 200 feet from the boundary or boundaries of the drilling unit so abutting or cornering such lands without exception being granted by the Director. BBC also requested that 640-acre, 320-acre, 160-acre and 80-acre drilling and spacing units be established for certain lands. In addition, BBC requested that for those lands which are unspaced, that all future Williams Fork Formation wells should be located downhole anywhere upon the lands but no closer than 100 feet from the boundaries of any lease line unless such lease line abuts or corners lands in respect of which the Commission has not at the time of a drilling application granted the right to drill 10 acre density wills in which event the wells should be drilled downhole no closer than 200 feet from the lease line which so abuts or corners the lands in respect of which 10 acre density downhole drilling for Williams Fork Formation wells has not been ordered by the Commission. BBC does not intend to drill more than four (4) Williams Fork Formation wells per quarter quarter section.
FINDINGS
The Commission finds as follows:
1. On February 22, 1994, the Commission issued Order No. 191-4, which amended Order No. 191-3 which established 640-acre drilling and spacing units for the production of gas and associated hydrocarbons from the Mesaverde Formation, with the permitted well to be located no closer than 990 feet to the boundaries of the unit for the below-listed lands:

2. On October 21, 1997, the Commission issued Order No. 191-5, which amended Order No. 191-4 which established 640-acre drilling and spacing units for the production of gas and associated hydrocarbons from the Mesaverde Formation, with the permitted well to be located no closer than 990 feet to the boundaries of the unit, to allow additional wells, not to exceed sixteen (16) wells, for the production of oil, gas and associated hydrocarbons from the Mesaverde Group, with the permitted well to be located at a distance of at least 400 feet from the outer boundaries of the drilling and spacing unit and no closer than 800 feet to any well or wells producing or producible from the same formation including Section 25, Township 6 South, Range 92 West, 6th P.M.
3. On October 21, 1997, the Commission issued Order No. 191-5, which amended Order No. 191-4 which established 640-acre drilling and spacing units for the production of gas and associated hydrocarbons from the Mesaverde Formation, with the permitted well to be located no closer than 990 feet to the boundaries of the unit, to decrease the 640-acre drilling and spacing unit consisting of Section 36, Township 6 South, Range 92 West, 6th P.M. to 40-acre drilling and spacing units for the production of oil, gas and associated hydrocarbons from the Mesaverde Group, with the permitted well to be located in accordance with Rule 318.a.
4. On December 2, 2002, the Commission issued Order No. 191-6, which rescinded Section 23, Township 6 South, Range 92 West, 6th P.M. from the provisions of Order No. 191-3, which had established a 640-acre drilling and spacing unit consisting of said Section 23, for the production of gas and associated hydrocarbons from the Mesaverde Formation.
5. Rule 318.a. of the Rules and Regulations of the Commission requires that wells drilled in excess of two thousand five hundred (2,500) feet in depth be located not less than six hundred (600) feet from any lease line, and located not less than one thousand two hundred (1,200) feet from any other producible or drilling oil or gas well when drilling to the same common source of supply, unless authorized by order of the Commission upon hearing. The below-listed lands are subject to Rule 318.a.:

In addition, the application also requested that the order increase the number of wells which can be optionally drilling into and produced from the Williams Fork Formation in the below-listed 40-acre drilling and spacing units, the equivalent of one well per 10 acres, with the permitted well to be located downhole anywhere in the drilling and spacing unit, no closer than 100 feet from the boundaries of the unit without exception being granted by the Director of the Oil and Gas Conservation Commission. Where these lands abut or corner lands in respect of which the Commission has not at the time of drilling permit application granted the right to drill 10-acre density Williams Fork Formation wells, the well should be located downhole no closer than 200 feet from the boundary or boundaries of the drilling unit so abutting or cornering such lands without exception being granted by the Director of the Oil and Gas Conservation Commission.

The application also requested that the order establish 320-acre drilling and spacing units for the production of gas and associated hydrocarbons from the Williams Fork Formation, for the below-listed lands, with the permitted well to be located downhole anywhere in the drilling and spacing unit but no closer than 100 feet from the boundaries of the unit without exception being granted by the Director of the Oil and Gas Conservation Commission. Where these lands abut or corner lands in respect of which the Commission has not at the time of drilling permit application granted the right to drill 10-acre density Williams Fork Formation wells, the well should be located downhole no closer than 200 feet from the boundary or boundaries of the drilling unit so abutting or cornering such lands without exception being granted by the Director of the Oil and Gas Conservation Commission. In addition, the application also requested that the order establish 160-acre drilling and spacing units for the production of gas and associated hydrocarbons from the Williams Fork Formation, for the below-listed lands, with the permitted well to be located downhole anywhere in the drilling and spacing unit but no closer than 100 feet from the boundaries of the unit without exception being granted by the Director of the Oil and Gas Conservation Commission. Where these lands abut or corner lands in respect of which the Commission has not at the time of drilling permit application granted the right to drill 10-acre density Williams Fork Formation wells, the well should be located downhole no closer than 200 feet from the boundary or boundaries of the drilling unit so abutting or cornering such lands without exception being granted by the Director of the Oil and Gas Conservation Commission. 11. Further, the application also requested that the order establish 80-acre drilling and spacing units for the production of gas and associated hydrocarbons from the Williams Fork Formation, the below-listed lands, with the permitted well to be located downhole anywhere in the drilling and spacing unit but no closer than 100 feet from the boundaries of the unit without exception being granted by the Director of the Oil and Gas Conservation Commission. Where these lands abut or corner lands in respect of which the Commission has not at the time of drilling permit application granted the right to drill 10-acre density Williams Fork Formation wells, the well should be located downhole no closer than 200 feet from the boundary or boundaries of the drilling unit so abutting or cornering such lands without exception being granted by the Director of the Oil and Gas Conservation Commission. In addition, the order should allow the number of wells which can be optionally drilled into and produced from the Williams Fork Formation to the equivalent of one well per 10 acres.

12. The application also requested that as to the below-listed lands [unspaced], the order should allow all future Williams Fork Formation wells to be located downhole anywhere upon such lands but no closer than 100 feet from the boundaries of any lease line unless such lease line abuts or corners lands in respect of which the Commission has not at the time of drilling permit application granted the right to drill 10-acre density wells in which event the wells should be drilled downhole no closer than 200 feet from the lease line which so abuts or corners the lands in respect of which 10 acre density downhole drilling for Williams Fork Formation wells has not been ordered by the Commission. In addition, the order should allow the number of wells which can be optionally drilled into and produced from the Williams Fork Formation to the equivalent of one well per 10 acres.

13. Subsequent to the filing of the application and prior to the matter being noticed for hearing, the request for an order to establish a 320-acre drilling and spacing unit consisting of the N½ of Section 19, Township 6 South, Range 91 West, 6th P.M. was withdrawn.
14. On December 17, 2004, BBC filed with the Commission a letter stating that it has agreed with Garfield County that it would not drill on its operated lands within the moratorium area established under the Commission’s Order No. 1V-276 so long as the order is in effect or until BBC has filed an application with the Commission and has been released from the order as it applies to the BBC operated lands within the moratorium area. In addition, BBC stated its stipulation to change the language submitted in the application from “unless exception is granted by the Director of the Colorado Oil and Gas Conservation Commission” to “unless exception is granted by the Colorado Oil and Gas Conservation Commission pursuant to application made for such an exception”. BBC requested that these provisions be included in any order issued.
15. On December 23, 2004, Barry Stout filed with the Commission a protest to the application.
16. On December 27, 2004, West Valley Development, LLC, through its attorney, filed with the Commission a Protest and Written Comments.
17. On December 28, 2004, a prehearing conference was held and the protests were dismissed.
18. Testimony and exhibits presented at the administrative hearing showed the proposed ten (10) acre density application lands, and the proposed and current spacing or setbacks for the application lands.
19. Testimony and exhibits presented at the administrative hearing showed a type log for the Mesaverde Group in the Gibson Gulch Area, with the many vertically stacked fluvial, meander belt point bar sand bodies present in the Williams Fork Formation in the application area. The Williams Fork Formation, which is approximately 3,500 feet thick in the area, consists of sandstones, shales and coals which were deposited in a non-marine, meandering stream environment. The lower portion of the formation consists of a continuously gas saturated interval. The sands that are completed for gas production are in the gas saturated interval. Testimony showed that the sand bodies in the Williams Fork Formation are highly discontinuous, with very limited lateral extent and very low permeability.
20. Testimony and exhibits presented at the administrative hearing showed a photograph of a Mesaverde Group Outcrop in Coal Canyon Near Cameo, Colorado, which is approximately 40 miles west of Mam Creek Field. The photograph showed the Rollins Formation at the base of the Williams Fork Formation, and numerous examples of the highly discontinuous fluvial Williams Fork Formation sand lenses.
21. Testimony and exhibits presented at the administrative hearing showed a summary of the results of the measurements of the Williams Fork Formation sand body sizes made by Mr. Rex Cole at the Mesaverde Group Outcrop in Coal Canyon Near Cameo, Colorado. The average lateral extent of the one hundred thirty seven (136) sand bodies that were measured is approximately five hundred twenty-six (526) feet, and that approximately eighty percent (80%) of the sand bodies measured had a lateral extent of seven hundred (700) feet or less, and that 60% of the sand bodies measured had a lateral extent of five hundred (500) feet or less. Additional testimony showed that this is very consistent with a theoretical ten (10) acre density lateral extent of six hundred and sixty (660) feet.
22. Testimony and exhibits presented at the administrative hearing showed a log cross section in the Gibson Gulch Federal Unit showed that many of the meander belt point bar sand bodies are not correlatable between existing wells with setbacks as close as six hundred eighty six (686) feet. Further testimony showed that wells drilled under setbacks equivalent to ten (10) acre density would intersect very few, if any, of the same sand bodies, and that only gas from the sand bodies that are intersected by a well is produced into the well.

Testimony and exhibits presented at the administrative hearing showed a diagram of sandstone bodies with hypothetical 10-acre density wells, modified from work done by Dr. Lorenz from the Sandia National Laboratory which indicated that wells drilled as close as six hundred sixty (660) feet, which is equivalent to ten (10) acre density, would not penetrate the same sand bodies, even though they would appear to correlate on cross sections.
24. Testimony and exhibits presented at the administrative hearing of diagrams that show natural and drilling induced fractures interpreted from a borehole image log showed that both types of fractures have very similar orientations. Additional testimony indicated that because the natural and hydraulic fractures are near parallel, the drainage pattern for wells in highly elliptical.
25. Testimony and exhibits presented at the administrative hearing showed the estimated ultimate recovery per well for the existing wells in the application lands. Further testimony showed that the average EUR is eight hundred six (806) MMCFG, with a statistical mean of eight hundred fifty-three (853) MMCFG.
26. Testimony and exhibits presented at the administrative hearing showed the estimated volumetric gas in place on a 10-acre basis for the wells in the application lands. Additional testimony showed that the average original gas in place is one thousand one hundred seventy three (1173) MMCFG and the average recoverable gas in place is nine hundred fifty (950) MMCFG.
27. Testimony and exhibits presented at the administrative hearing showed a summary of gas in place and recoverable gas showing gas in place estimates from a number of different studies, including studies performed by the United States Geological Survey, the Multiwell Experiment, the Gas Research Institute, Barrett Resources, and Petroleum Development Corporation. Additional testimony showed that BBC estimates the original gas in place as seventy-five and one tenth (75.1) BCF per six hundred forty (640) acres. Further testimony showed that the estimated incremental recovery with three (3) additional wells on 40-acres is two and eight tenths (2.8) BCF.
28. Testimony and exhibits presented at the administrative hearing showed that drilling ten (10) acre density wells in the application area will yield an economic rate of return acceptable to BBC, and that the ten (10) acre density wells would produce economically recoverable gas that would otherwise not be produced.
29. The above-referenced testimony and exhibits show that the proposed density will allow more efficient drainage, will prevent waste, will not violate correlative rights and will assure a greater ultimate recovery of gas and associated hydrocarbons.
30. BBC commits that wells to be drilled in the application lands within a given quarter quarter section will be drilled from the surface either vertically or directionally from one pad located on that quarter quarter section. Further, whenever possible, BBC commits to attempt to drill wells in the application lands from one pad per eighty acres, to the extent not limited by surface owner agreements, topography or the ability to locate production facilities.
31. BBC agreed to be bound by oral order of the Commission.
32. The Hearing Officer should recommend to the Commission at its hearing on January 10, 2005 that the amended application be approved.

IT IS FURTHER ORDERED, that wells drilled in the application lands within a given quarter quarter section shall at a minimum be drilled from the surface either vertically or directionally from one pad located on that quarter quarter section, unless an exception is granted by the Colorado Oil and Gas Conservation Commission.
IT IS FURTHER ORDERED, that Bill Barrett Corporation shall not drill on its operated lands within the moratorium area established under the Commission’s Order No. 1V-276 so long as the order is in effect or until Bill Barrett Corporation has filed an application with the Commission and has been released from the order as it applies to the Bill Barrett Corporation operated lands within the moratorium area.
IT IS FURTHER ORDERED, that the provisions contained in the above order shall become effective forthwith.
IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend or repeal any and/or all of the above orders.
IT IS FURTHER ORDERED, that under the State Administrative Procedure Act the Commission considers this order to be final agency action for purposes of judicial review within thirty (30) days after the date this order is mailed by the Commission.
IT IS FURTHER ORDERED, that an application for reconsideration by the Commission of this order is not required prior to the filing for judicial review.
