REPORT OF THE COMMISSION
This cause came on for hearing before the Commission on October 17, 1967, at 10 a.m., in Room 132, State Services Building, Denver, Colorado, after publication of Notice of Hearing and receipt of Waivers of Service, as required by law and the rules and regulations of the Commission, on the application of Plains Exploration Company for an order granting an exception to Order No, 188-1, for a well to be drilled in the NEĽNEĽ Section 4, Township 19 South, Range 45 West, in the Brandon Field, Kiowa County, Colorado.
FINDINGS
The Commission finds as follows:
1. That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.
2. That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.
3. That in the past, a well located in the NEĽNEĽ, Section 4, Township 19 South, Range 45 West, had been drilled as a dry hole, and that on September 19, 1967, Applicant attempted re-entry of said dry hole, and that after considerable effort was unable to get into same.
4. That Applicant now desires to drill a well at a location in the NEĽNEĽ of said Section 4, Township 19 South, Range 45 West, being 990 feet south of the north line and 660 feet west of the east line, in an attempt to establish production in the Mississippian formation.
5. That testimony presented indicates that said requested location is 330 feet south of the abandoned well because, during completing,large [sic] acid-frac treatments are necessary, and at a closer distance communication could be established with the old hole, and that therefore such, an exception to the established spacing pattern for the Brandon Field should be allowed.
6. That no objection to Applicant's request was presented.
ORDER
NOW, THEREFORE, IT IS ORDERED that an exception to the established spacing pattern for the Mississippian formation in the Brandon Field is hereby allowed for a well to be located in the NEĽNEĽ, Section 4, Township 19 South, Range 45 West, 990 feet south of the north line and 660 feet west of the east line, and such well shall be permitted to produce the allowable production of 150 barrels of oil per day for this 80-acre tract.
IT IS FURTHER ORDERED, that the provisions contained in the above order shall be effective forthwith.
