REPORT OF THE COMMISSION
This cause came on for hearing before the Commission on September 15, 1964, at 10 a.m., in Room 132, State Services Building, Denver, Colorado, after publication of Notice of Hearing as required by law, and mailing of copies of the application pursuant to regulations of the Commission, on the application of Paul R. Turnbull, designated Unit Operator of the proposed Winston Field "J" Sand Unit, for an order approving a certain Unit Agreement attached to said application as Exhibit "2"; and further approving a proposed Plan of Secondary Recovery by Waterflooding the "J" sand formation underlying certain lands in Logan County, Colorado.
FINDINGS
The Commission finds as follows:
1. That due notice of the time, place, and purpose of the hearing has been given in all respects as required by law.
2. That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.
3. That the "J" sand formation underlying the Unit Area, as set forth in the Unit Agreement presented by Applicant for the Winston Field "J" Sand Unit, constitutes a common source of supply of oil and gas; and that said Unit Area is composed of the following described lands in Logan County, Colorado, to-wit:

4. That geological and engineering testimony presented at the hearing indicates that, under the proposed plan of operation, drainage onto the N½SE¼ of Section 6, Township 10 North, Range 52 West, will equal or exceed any counter-drainage therefrom.
5. That said Unit Agreement for the Winston Field "J" Sand Unit is necessary to increase the ultimate recovery of oil and gas from said Unit Area, and that it should therefore be approved as being in the public interest for conservation.
6. That Applicant's plan to institute secondary recovery of oil from the "J" sand formation underlying said Unit Area by the injection of water into an intake well to be drilled in the NE¼NE¼SW¼ of Section 6, Township 10 North, Range 52 West, will increase the ultimate recovery of oil and gas from said Unit Area, and that it should therefore be approved as being in the public interest for conservation.
7. That avoidable waste of oil and gas will be prevented by the operations proposed by Applicant, and that the correlative rights of all parties in said Unit Area will not be adversely affected and will be reasonably protected under such a plan of operation; and that in the interest of securing the greatest ultimate recovery of oil and gas from said reservoir, the prevention of waste and protection of correlative rights, this application should be granted.
ORDER
NOW, THEREFORE, IT IS ORDERED, that the following rules and regulations shall apply hereafter to the lands set forth in this order, in addition to other applicable rules and regulations and orders of the Commission, if any, heretofore adopted and not in conflict herewith:
Rule 1. The Winston Field "J" Sand Unit Area, as set forth in the Unit Agreement, is comprised of the following described lands in Logan County, Colorado, to-wit:

Rule 2. The Unit Agreement, providing for unit operations of the Winston Field "J" Sand Unit Area, is hereby approved.
Rule 3. Applicant's plan for secondary recovery of oil and gas from the "J" sand formation underlying said Winston Field "J" Sand Unit Area by the injection of water into an intake well to be drilled in the NE¼NE¼SW¼ of Section 6, Township 10 North, Range 52 West, 6th P.M., Logan County, Colorado, is hereby approved, and Paul R. Turnbull, as Unit Operator, is authorized to inject water into said reservoir through said injection well in such quantity as shall be reasonably determined by him to best achieve the maximum recovery of oil and gas without waste.
IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend or repeal any and/or all of the above orders, rules and regulations.
