REPORT OF THE COMMISSION
This Cause came on for hearing before the Commission on August 18, 1953 at ten o'clock A.M., Room 704 State Capitol Annex, Sherman Street and 14th Ave., Denver, Colorado, after publication of Notice of Hearing as required by law, on the petition of F. Kirk Johnson for an order from the Commission establishing three hundred and twenty (320) acre drilling and spacing units according to the governmental survey thereof, for the production of gas from the Muddy sand often referred to as the "D" sand, common source of supply underlying the South Half (S½) of Section Nine (9); Section Sixteen (16); North Half (N½) of Section Twenty-one (21); Southeast Quarter (SE¼) of Section Seventeen (17) and the Northeast Quarter (NE¼) of Section Twenty (20), Township Nine North (9N), Range Fifty-two West (52W) of the Sixth (6th) Principal Meridian, in Logan County, Colorado, which area is referred to in said petition as the Padroni Gas Field.
The applicant, F. Kirk Johnson, is the owner of oil and gas leases within the above described area, and has heretofore completed its Giacomini well No. 1, located in the Northwest Quarter (NW¼) of Section Twenty-One in Township Nine North (9N), Range Fifty-two West (52W) of the Sixth (6th) Principal Meridian, Logan County, Colorado, in the Muddy or "D" Sand, the top of which is found at the approximate depth of 4481 feet below the surface. Evidence and testimony presented at the hearing disclosed that one well will adequately drain recoverable gas underlying three hundred and twenty (320) acres in the Muddy or "D" Sand, and that three hundred and twenty (320) acres is not smaller than the maximum area which can be efficiently drained by one well producing from the Muddy or "D" Sand.
FINDINGS
The Commission finds as follows:
1. That due notice of the time, place, and purpose of the hearing has been given in all respects as required by law.
2. That the Commission has jurisdiction over the subject matter embraced in said notice and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.
3. That the Muddy Sand Pool, sometimes referred to as the "D" Sand Pool, in the Padroni Gas Field, as used herein, constitutes a common source supply of gas underlying the following described lands in Logan County, Colorado:

All in Township Nine North (9N), Range Fifty-two West (52W) of the Sixth (6th) Principal Meridian, in Logan County, Colorado.
4. That in order to prevent waste of gas, as defined in the Colorado Oil and Gas Conservation Act of 1951, as amended, and to prevent the drilling of unnecessary wells, an order should be made establishing three hundred and twenty (320) acre drilling and spacing units for the production of gas from the said Muddy or "D" Sand Pool, common source of supply underlying said land as defined herein; that said units should consist of three hundred and twenty (320) acres as shown in Exhibit "A" attached hereto and made a part hereof, setting forth the units which are numbered One (1) through Five (5), and the permitted well should be located anywhere on said units but no less than six hundred and sixty (660) feet from the property lines.
5. That all available geological and engineering data concerning said Muddy or "D" Sand Pool in the Padroni Gas Field area indicate that one well should efficiently and economically drain an area of approximately three hundred and twenty (320) acres, and that units of the size and shape as set forth in Exhibit "A" attached hereto and made a part hereof are not smaller than the maximum area that can be efficiently drained by one well producing from the said Muddy or "D" Sand Pool.
ORDER
IT IS THEREFORE ORDERED, that the following rules and regulations shall apply hereafter to a well drilled, completed or recompleted in the Muddy or "D" Sand Pool of the Padroni Gas Field, in Logan County, Colorado, as herein defined in the Report of the Commission, which by reference are made a part hereof, in addition to other applicable rules and regulations and orders of the Commission, if any, heretofore adopted and not in conflict herewith:
Rule 1. Three Hundred and Twenty (320) acre drilling and spacing units shall be, and the same are hereby established for the production of gas from the Muddy Sand Pool, or "D" Sand Pool, common source of supply underlying the South Half (S½) of Section Nine (9); Section Sixteen (16); the North Half (N½) of Section Twenty-one (21); the Southeast Quarter (SE¼) of Section Seventeen (17); the Northeast Quarter (NE¼) of Section Twenty (20); in Township Nine North Range Fifty-two West (52W) of the Sixth (6th) Principal Meridian, all in Logan County, Colorado, and such area shall henceforth be known as the Padroni Gas Field.
Rule 2. The said units shall consist of three hundred and twenty (320) acres as shown in Exhibit "A" attached hereto and made a part hereof, setting forth the units which are numbered One (1) through Five (5) and the permitted well may be located no closer than six hundred and sixty (660) feet from the property lines.
IT IS FURTHER ORDERED, that by order of the Commission, after due notice and hearing, the said Muddy Sand Pool, or "D" Sand Pool, in the Padroni Gas Field, Logan County, Colorado, may be redesignated from time to time to embrace other lands in the vicinity which ape believed on the basis of additional development to be capable of producing gas from said Muddy Sand Pool, or "D" Sand Pool, common source of supply.
IT IS FURTHER ORDERED, that the rules and regulations contained herein shall become effective forthwith, and henceforth the commencement of the drilling of any well or wells in the Muddy Sand Pool, or "D" Sand Pool, as defined herein, or the purpose of producing gas therefrom at a location other than authorized by this Order, is hereby prohibited.
IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice of hearing, to alter, amend, or repeal any and/or all of the above rules and regulations.
