ORDER NO. 170-2

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on March 19, 1963, at 10 a.m., in Room 132, State Services Building, Denver, Colorado, after publication and service of Notice of Hearing, or appropriate waiver thereof, all as required by law, on the application of the Allison Drilling Company for an order requiring the pooling of tracts of land lying within the drilling unit defined as the W½NE¼, E½NW¼, NW¼SE¼, NE¼SW¼, and Lots 1, 2 and 3 Section 31, Township 1 North, Range 55 West, 6th P.M., Morgan County, Colorado, for the development and operation of the "J" sand formation underlying said lands; and allocating production from the Allison Drilling Company, Inc. No. 1 Bolinger well among the separately owned tracts in the proportion that the number of acres in such tract bears to the total number of acres within said drilling unit.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3.      That the "J" sand formation constitutes a common source of supply of gas underlying the drilling unit described in Order No. 170-1, Hunter Field.

 

4.      That in order to insure proper and efficient development; to eliminate the drilling of unnecessary wells; to promote conservation of the gas resources of the State, and to conform with the previously issued order of the Commission which established a drilling unit for the production of gas from the "J" sand formation underlying said lands, an order should be made pooling all interests in said drilling unit.

 

5.      That the Allison Drilling Company, Inc. is the operator of the oil and gas leases covering lands comprising said drilling unit.

 

6.      That an order of the Commission pooling all interests in said drilling unit is necessary, just and reasonable in order to afford each owner of interest the opportunity to recover and receive his just and equitable share of the gas produced from the "J" sand formation underlying said drilling unit.

 

7.      That at the hearing, all interested parties agreed that production obtained from the Allison Drilling Company, Inc No. 1 Bollinger well, located in the SW¼NW¼ (Lot 2) of Section 31, Township 1 North, Range 55 West, 6th P.M., 1987 feet from the north section line and 637 feet from the west section line of said Section 31, should be allocated among the separately owned tracts in the proportion that the number of acres in such tract bears to the total number of acres within said drilling unit.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that pursuant to the provisions of 100-6-4 of the Oil and Gas Conservation Act of the State of Colorado, all interests in the drilling unit described as the W¼NE¼, E½NW¼, NW¼SE¼, NE¼SW¼, and Lots 1, 2 and 3, Section 31, Township 1 North, Range 55 West, 6th P.M., Morgan County, Colorado, are hereby pooled for the development and operation of the Allison Drilling Company, Inc. No. 1 Bolinger well, located in the SW¼NW¼ (Lot 2) of said Section 31.

 

IT IS FURTHER ORDERED, that the gas production obtained from the "J" sand formation underlying said drilling unit shall be allocated among the separately owned tracts in the proportion that the number of acres in such tract bears to the total number of acres within said drilling unit.

CAUSE NO. 170

 

ORDER NO. 170-2      (Clarification)

 

The Commission has been informed that some uncertainty may have been inadvertently created by the wording of paragraphs 1 and 2 of Order No. 170-2.

 

For the purposes of clarification of said Order No. 170-2, the following changes are made in the language of paragraphs 1 and 2 of Order No. 170-2, and they shall now read as follows:

 

NOW, THEREFORE, IT IS ORDERED, that pursuant to the provisions of 100-6-4 of the Oil and Gas Conservation Act of the State of Colorado, all interests in the drilling unit established for the production of gas from the "J" sand and described as the W½NE¼, E½NW¼, NW¼SE¼, NE¼SW¼, and Lots 1, 2 and 3, Section 31, Township 1 North, Range 55 West, 6th P.M., Morgan County, Colorado, are hereby pooled for the development and operation thereof.

 

IT IS FURTHER ORDERED, that the permitted well for said drilling unit shall be the Allison Drilling Company, Inc. No. 1 Bolinger well, located in the SW¼NW¼ (Lot 2) of Section 31, Township 1 North, Range 55 West, 6th P.M., 1987 feet from the north section line and 637 feet from the west section line of said Section 31; and that the "J" sand gas production obtained from said well shall be allocated among the separately owned tract, in the proportion that the number of acres in such tract bears to the total number of acres within said drilling unit.

 

ORDERED this 1st day of May 1963.
