CAUSE NO. 160

ORDER NO. 160-1

REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on January 16, 1962, at 10 a.m., in Room 330, State Office Building, Denver, Colorado, after publication of Notice of Hearing as required by law, on the application of the M and F Oil and Gas Company for an order establishing a 640-acre drilling and spacing unit for the production of gas from the Ismay zone, common source of supply underlying Section 6, Township 36 North, Range 18 West, N.M.P.M., Montezuma County, Colorado.  At the hearing, this application was amended as to size of the drilling unit, and corrected as to location of the well.

FINDINGS

The Commission finds as follows:

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3.      That the Ismay Zone of the Paradox formation constitutes a common source of supply of gas underlying Section 6, Township 36 North, Range 18 West, N.M.P.M., Montezuma County, Colorado.

4.      That in order to prevent waste, as defined in the Colorado Oil and Gas Conservation Act; and to prevent the drilling of unnecessary wells, an order should be made establishing a 640-acre drilling and spacing unit for the production of gas from the Ismay Zone of the Paradox formation, common source of supply underlying the land defined herein, and that said unit should be a 640-acre drilling and spacing unit according to the governmental, survey thereof, and such unit should be a whole section, as herein described; and that the permitted gas well for such drilling and spacing unit should be the M and F Oil & Gas Co. No. 3 Rowley Federal Well located 1890 feet from the west line and 660 feet from the south line of Section 6, Township 36 North, Range 18 West, N.M.P.M., Montezuma County, Colorado.

5.      That all available geological and engineering data presently known to the Commission concerning said Ismay zone in the Goodman Point Field seems to indicate that one well will efficiently and economically drain an area of approximately 640 acres as to gas, and that a drilling and spacing unit of the size and shape herein described appears not to be smaller than the maximum area that can be efficiently drained by one gas well producing from said Ismay zone.

ORDER

NOW, THEREFORE, IT IS ORDERED that a Six Hundred Forty (640) acre drilling and spacing unit, according to the governmental survey thereof, shall be and the same is hereby established for the production of gas from the Ismay Zone of the Paradox formation, common source of supply underlying Section 6, Township 36 North, Range 18 West, N.M.P.M., Montezuma County, Colorado, and the permitted gas well for such unit shall be the M and F Oil & Gas Co. No. 3 Rowley Federal Well, located 1890 feet from the west line and 660 feet from the south line of said Section 6.

IT IS FURTHER ORDERED, that the Commission expressly reserves its right after notice and hearing, to alter, amend or repeal any and/or all of the above order.

ORDERED this 16th day of January 1962.
