REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on March 17, 1953 at ten o'clock A.M. Room 704 State Capitol Annex, Sherman Street and 14th Avenue, Denver, Colorado, after publication of notice of hearing as required by law, on the petition of F. Kirk Johnson for an order from the Commission establishing 320-acre drilling and spacing units according to the governmental survey thereof, for the production of gas from the "J" Sand of the Dakota series, common source of supply underlying the SE¼ of Section 25; the E½ of Section 36; in Twp. 8N, Range 51W; the S½ of Section 30; the SW¼ of Section 29; all of Section 31; the NW¼ of Section 32 in Twp. 8N, Range 50W; the N½ of Section 6, Twp. 7N Range 50W, and the NW¼ of Section 1, 8N, Range 51W, all in Logan County, Colorado, which area is referred to in said petition as the Frenchman Creek area.

 

The applicant, F. Kirk Johnson, is the owner of oil and gas leases within the above described area, and has heretofore completed its No. 1 State well, which is located in the SE¼SE¼NE¼ of Section 31, Twp. 8N, Range 50W, at approximate depth of 4790 feet, in the "J" Sand. Testimony was taken at the hearing, and the hearing was continued to April 16, 1953, at 10 o'clock A.M., 330 State Office Building, Denver, Colorado, at which time further testimony was taken.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place and purpose or the hearing has been given in all respects as required by law.

 

2. That the Commission has jurisdiction over the subject matter embraced in said notice and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order. That the "J" Sand pool in the Frenchman Creek area constitutes a common source of supply of gas. That in order to prevent waste of gas, as defined in the Colorado Oil and Gas Conservation Act of 1951, as amended, and to prevent the drilling of unnecessary wells, an order should be made establishing 160-acre drilling and spacing units for the production of gas from the said "J" Sand pool, common source of supply underlying said land, as defined herein; that said units should consist of regular quarter sections, according to the governmental survey thereof, and the permitted wells should be located anywhere on said units but no less than 330 feet from the property line.

 

5. That all available geological and engineering data concerning the said "J" Sand Pool in the Frenchman Creek area indicate that one well should efficiently and economically drain an area o approximately 160 acres, and that units o the size and shape hereinabove described are not smaller than the maximum area that can be efficiently drained by one well producing from the said "J" Sand Pool.

 

ORDER

 

IT IS THEREFORE ORDERED, that the following rules and regulations shall apply hereafter to a well drilled, completed or recompleted in the "J" Sand Pool of the Frenchman Creek area, in Logan County, Colorado, as hereinabove defined in the Report of the Commission, which by reference are made a part hereof, in addition to other applicable rules and regulations and orders of the Commission, if any, heretofore adopted and not in conflict herewith:

 

Rule 1.    One Hundred Sixty (160)acre drilling and spacing units shall be, and the same are hereby established for the production of gas from the "J" Sand Pool, common source of supply underlying the SE¼ of Section the E½ of Section 36; in Twp. 8N, Range 51W; the S½ of Section 30; the SW¼ of Section 29; all of Section 31; the NW¼ of Section 32, in Twp. 8N, Range 50W; the N½ of Section 6, Twp. 7N, Range 50W, and the NW¼ of Section 1, Twp. 7N Range 51W, all in Logan County, Colorado; and such area shall henceforth be known as the Frenchman Creek Field.

 

Rule 2.    The said units shall consist of regular governmental quarter sections, according to the governmental survey thereof, and the permitted wells for each unit may be located no closer than 330 feet from the property line.

 

IT IS FURTHER ORDERED, that by order of the Commission, after due notice and hearing, the said "J" Sand Pool in the Frenchman Creek Field, Logan County, Colorado, may be redesignated from time to time to embrace other lands in the vicinity which are believed on the basis of additional development to be capable of producing gas from the said "J" Sand Pool, common source of supply.

 

IT IS FURTHER ORDERED, that the rules and regulations contained herein shall become effective forthwith, and henceforth the commencement of the drilling of any well or wells in the "J" Sand Pool, as defined herein, for the purpose of producing gas therefrom at a location other than authorized by this Order, except as herein provided, is hereby prohibited.
