ORDER NO. 156-5

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on December 18, 1962, at 10 a.m., in Room 132, State Services Building, Denver, Colorado, after publication of Notice of Hearing and appropriate waiver of service thereof, all as required by law and the rules and regulations of the Commission, on the application of Frank O. Elliott for an order decreasing the size of the drilling unit covering the SW¼ of the SE¼ of Section 22, Township 35 North, Range 20 West, N.M.P.M., in the Flodine Park Field, as an exception to Order No. 156-1; and designating as the drilling unit for the SW¼ of the SE¼ of said Section 22, the 40-acre legal subdivision comprising said SW¼ of the SE¼ of said Section 22, with the permitted well location for such drilling unit being the center thereof, with a tolerance of 150 feet in any direction for surface conditions.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3.      That on October 3, 1961, the Commission issued its Order No. 156-1, and that Finding 5 of said order states, in part, that geological and engineering data indicates that one well will efficiently and economically drain an area of approximately eighty (80) acres in the Ismay zones of the Hermosa formation, Flodine Park Field; and that no testimony was introduced at the above hearing to refute this finding.

 

4.      That the forming of a 40-acre drilling unit within an established 80-acre drilling unit would not protect the correlative rights of all interests in said 80-acre unit; therefore, in order to prevent the drilling of unnecessary wells, and to protect the correlative rights of all interests in the W½SE¼ of Section 22, Township 35 North, Range 20 West, N.M.P.M., in the Flodine Park Field, Montezuma County, Colorado, the application should be denied.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that the application of Frank O. Elliott for modification and amendment of the Commission Order No. 156-1, to permit Applicant to create a 40-acre drilling unit comprised of the SW¼ of the SE¼ of Section 22, Township 35 North, Range 20 West, N.M.P.M., in the Flodine Park Field, Montezuma County, Colorado, with the permitted well location in the center thereof, is hereby denied.
