ORDER NO. 156-3

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on February 20, 1962, at 10 A.M., in Room 132, State Services Building, Denver, Colorado, after publication of Notice of Hearing as required by law, on the application of Ralph E. May, for an order restricting production of oil to fifty barrels per day for the Ohio No. 2 Government well SW¼SW¼, Section 15, and the Ohio No. 3 Government well, SE¼SW¼, Section 15, Township 35 North, Range 20 West, N.M.P.M.. Montezuma County, Colorado, until such time as the development of Lot 5, Section 22, can take place.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested, therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3.      That on February 19, 1962, Ralph E. May, applicant, filed with the Commission a written request for the hearing date in the above entitled matter to be reset in approximately six months.

 

4.      That no useful purpose will be served at this time by the granting of such continuation of hearing and permitting the application to remain pending.

 

5.      That such request for continuation should, be denied and subject application be dismissed without prejudice, and that Ralph E. May may file another application for hearing in this cause at any time convenient to him.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED that the request by Ralph E. May for continuation of hearing for approximately six months on his application in the above entitled matter is hereby denied, and subject application is dismissed without prejudice, with the provision that Applicant may file another application for hearing in this cause at any time convenient to him.
