REPORT OF THE COMMISSION
This cause came on for hearing before the Commission on June 23, 1959, at 10 a.m., in the Game Room of the Albany Hotel, Denver, Colorado, after publication of Notice of Hearing as required by law, on the application of Texaco, Inc. for an order establishing 320-acre drilling and spacing units for the production of gas from the Wasatch, the Fort Union-Lance-Lewis, and the Mesaverde pools underlying certain lands in Moffat County, Colorado providing that present producing wells be accepted as the permitted gas wells for the gas drilling units upon which they are located; providing that future wells shall be located not less than 660 feet from the boundary line of any gas drilling unit; providing that at any one time, no more than one gas well on each gas drilling unit shall be permitted to produce from any one of the three pools listed above; approving the multiple completion of Wasatch pool gas production with, but segregated from, other pools producing in the same well; and approving the commingling of gas production from the Fort Union-Lance-Lewis pool and the Mesaverde pool.
FINDINGS
The Commission finds as follows:
1. That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.
2. That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.
3. That testimony presented at the hearing indicates that, based on geologic and engineering information presently available, the Wasatch pool, the Fort Union-Lance-Lewis pool, and the Mesaverde pool contain common sources of supply of gas underlying the following described lands in Moffat County, Colorado, to-wit:

and that such area should henceforth be known as the Hiawatha-West Field.
4. That in order to prevent waste and to prevent the drilling of unnecessary wells, an order should be made establishing 320-acre drilling and spacing units for the production of gas from the pools as set forth in Finding 3 above; that said units should be approximately 320-acre drilling and spacing units, as set forth in Exhibit "A" attached herein; and that the wells presently capable of producing should be the permitted wells for the units on which they are located; and that wells to be drilled should be located not less than 660 feet from the boundary line of the drilling and spacing units on which they are to be located.
5. That all available geological and engineering data covering the pools set forth in Finding 3 hereof indicates [sic] that one well will be able to efficiently and economically drain an area of approximately 320 acres as to gas; and that drilling and spacing units of the size and shape herein described appear not to be smaller than the maximum area that can be efficiently drained by one gas well from said Wasatch pool, Fort Union-Lance-Lewis pool, and Mesaverde pool, common sources of supply.
6. That in order to prevent the drilling of unnecessary wells, the Wasatch pool should be permitted to produce with, but segregated from, the other pools by multiple completion in a single well bore; and that production from the Fort Union-Lance-Lewis and Mesaverde pools should be allowed to commingle in a common well bore; and that production practices, as outlined above, will result in an increase in ultimate recovery of gas from the Mesaverde pool, will prevent waste, and will be in the best interest of conservation.
ORDER
NOW, THEREFORE, IT IS ORDERED, that the following rules and regulations shall apply hereafter to a well drilled, completed or recompleted in the Wasatch pool, the Fort Union-Lance-Lewis pool, and the Mesaverde pool, common sources of supply underlying the Hiawatha-West Field, herein defined, in addition to other applicable rules and regulations and orders of the Commission, if any heretofore adopted and not in conflict herewith:
Rule 1. Drilling and spacing units of approximately Three Hundred Twenty (320) acres, as outlined on Exhibit "A" attached hereto and made a part hereof, shall be and the same are hereby established for the production of gas from the Wasatch pool, the Fort Union-Lance-Lewis pool, and the Mesaverde pool, common sources of supply underlying the following described lands in Moffat County, Colorado, to-wit:

Lots Three (3) through Six (6), Section Seventeen (17); Lots Five (5) through Twelve (12); Section Eighteen (18); all of Section Nineteen (19); West Half (W½) of Section Twenty (20); Northwest Quarter (NW¼) of Section Twenty-nine (29); and all of Section Thirty (30), Township Twelve (12) North, Range One Hundred (100) West of the 6th P.M.; and |

Lots One (1) through Eight (8), Section Thirteen (13); Lots One (1) through Eight (8), Section Fourteen (14); Lots One (1), Two (2), Seven (7) and Eight (8), Section Fifteen (15); East Half (E½) of Section Twenty-two (22); all of Sections Twenty-three (23), Twenty-four (24), Twenty-five (25), and Twenty-six (26); East Half (E½) of Section Twenty-seven (27); Northeast Quarter (NE¼) of Section Thirty-four (34); North Half (N½) of Section Thirty-five (35), and North Half (N½) of Section Thirty-six (36), Township Twelve (12) North, Range One Hundred One (101) West of the 6th P.M., |
and such area shall henceforth be known as the Hiawatha-West Field.
Rule 2. The permitted well for each such drilling and spacing unit shall be located not closer than Six Hundred Sixty (660) feet from the boundary line of each such drilling unit, and the wells previously drilled and capable of producing shall be the permitted wells for the units on which they are located.
Rule 3.
(a) Multiple zone completion of production from the Wasatch pool with the production from other pools is hereby permitted, provided that no commingling occurs in the well bore.
(b) Dual completion, with commingling in the well bore, of the Fort Union-Lance-Lewis and Mesaverde pools is hereby permitted.
IT IS FURTHER ORDERED, that the provisions of this order shall apply to all operators and owners of wells capable of producing from the Wasatch, Fort Union-Lance-Lewis, and Mesaverde pools underlying the Hiawatha-West Field, and shall remain in effect unless otherwise authorized by the Commission.
IT IS FURTHER ORDERED, that this order shall become effective forthwith.
IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend or repeal any and/or all of the above orders, rules and regulations.
