ORDER NO. 128-3

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on February 18, 1975 at 9 a.m., in Room 532, State Services Building, Denver, Colorado, after giving Notice of Hearing as required by law, on the Commission's own motion to consider the rescinding of Order Nos. 128-1 and 128-2 for the Rake Field.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3.      That on May 6, 1959, the Commission issued its Order No. 128-1 which provided that gas produced from the "D" Sand in wells located within an area described as the S½ Section 23 and the N½ Section 26, Township 4 North, Range 60 West, 6th P.M., be (1) marketed and sold to supply domestic, industrial, commercial, or municipal needs; or (2) used for lease fuel, development or operations or (3) returned to the "D" Sand reservoir.  On April 19, 1966, the Commission issued its Order No. 128-2 which approved a project for water injection into the "D" Sand reservoir.

 

4.      That since the wells in the area described in Finding 3 herein, as well as the water injection well, are now plugged and abandoned, and in order to promote future development the provisions of Order Nos. 128-1 and 128-2 are no longer necessary and should be rescinded.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that Order Nos. 128-1 and 128-2 in Cause No. 128 for the Rake Field Morgan County, Colorado, are hereby rescinded, and operations in the area as described in Finding 3 herein, shall be governed by the general rules and regulations of the Commission.
