REPORT OF THE COMMISSION
This cause came on for hearing before the Commission on April 30, 1959, at 10 a.m., in the Spruce Room of the Albany Hotel, Denver, Colorado, after publication of Notice of Hearing and service or appropriate waiver thereof, all as required by law, on the application of The British-American Oil Producing Company for an order establishing a 600-acre drilling and spacing unit for the production of gas from the D4 sand underlying the Horsetail Field, Logan County, Colorado, with the McRoberts G-1 well as the permitted gas well for such drilling unit, and requiring the pooling of all interests in said 600-acre unit.
FINDINGS
The Commission finds as follows:
1. That due notice of the time, place and purpose of the hearing has been given to parties interested therein in all respects as required by law.
2. That the Commission has jurisdiction over the subject matter embraced in said notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order,
3. That insufficient evidence was presented at the hearing in this matter to substantiate the application of The British-American Oil Producing Company for a 600-acre drilling and spacing unit for the production of gas from the D4 sand formation underlying the Horsetail Field.
ORDER
NOW, THEREFORE, IT IS ORDERED that the application of The British-American Oil Producing Company for the formation of a 600-acre drilling and spacing unit for the production of gas from the D4 sand formation underlying the Horsetail Field, Logan County, Colorado, and the pooling of the interests in said unit, is hereby denied.
