REPORT OF THE COMMISSION
On March 14, 1958, The [sic] Oil and Gas Conservation Commission of the State of Colorado issued its Order No. 116-1, which requires that certain tests be taken on wells capable of producing from the "D" sand underlying the Bijou Area in Morgan County, Colorado.
FINDINGS
The Commission finds as follows:
1. That the Commission has jurisdiction to promulgate the hereinafter prescribed order.
2. That an emergency exists requiring immediate action by the Commission, and that an emergency order should be issued in accordance with the provisions of 100-6-7(3) CRS 1953, as amended.
3. That the production of gas from wells producing from the "D" sand underlying the area described in Finding 5 hereof is resulting in a flare of approximately 10,000,000 cubic feet of gas per day from approximately eighteen (18) producing wells, which flare is constantly increasing; and that present production practices will result in an irrecoverable loss of gas in excess of approximately 130,000,000 cubic feet before a formal hearing can be held on this matter; and that such production practices constitute waste, as that term is defined in 100-6-3(10) CRS 1953, as amended.
4. That in order to prevent waste and to prevent the escaping, blowing, and releasing of gas in an excessive or unreasonable amount from wells capable of producing both oil and gas, the maximum daily production of gas from any one well producing from the "D" sand formation underlying the area described in Find.5 [sic] hereof should not exceed an approximate volume of 150,000 cubic feet provided, however, that no gas should be produced from any well which has a producing gas-oil ratio of 20, 000 cubic feet per barrel, or greater.
5. That all wells capable of producing from the "D" sand underlying the following area should comply with the provisions of this order:

ORDER
NOW, THEREFORE, IT IS ORDERED, that in order to prevent waste and to prevent the escaping, blowing, and releasing of gas in an excessive or unreasonable amount from wells capable of producing both oil and gas, the maximum daily production of gas from any one (1) well producing from the "D" sand formation underlying the area described in Finding 5 hereof, which by reference is made a part hereof, shall not exceed an approximate volume of One Hundred Fifty Thousand (150,000) cubic feet; provided, however, that no gas shall be produced from any well which has a producing gas-oil ratio of Twenty Thousand (20,000) cubic feet per barrel, or greater.
IT IS FURTHER ORDERED, that this order shall be effective [sic] fifteen (15) days, commencing August 6, 1958.
