REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on October 19, 1987, at 9:00 A.M., in Room 110, State Centennial Building, 1313 Sherman Street, Denver, Colorado, after giving Notice of Hearing as required by law, on the application of Amoco Production Company for approval to use Well No. 1-4 Ohnemus, located in the NW/4 SE/4 Section 4, Township 33 South, Range 7 West, N.MP.M., La Plata County, Colorado as a water disposal well into the Mesaverde formation. Protests to the granting of the application were received.

 

FINDINGS

 

The Commission finds as follows:

 

1.      Amoco Production Company, as applicant herein, is an interested party in the subject matter of the above-referenced hearing.

 

2.      Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

3.      The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

4.      Based on the review by the staff and statements made by Amoco at the time of hearing concerning protection of the environment, the request to convert well No. 1-4 Ohnemus, located in the NW1/4 SE1/4 Section 4, Township 33 South, Range 7 West, N.M.P.M., La Plata County, Colorado should be approved and that operations of this well as a disposal well for water from Fruitland Coal Seam well into the Mesaverde formation should be in accordance with Rule 326 and 327 of the Rules and Regulations of the Commission.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that approval is hereby granted for Well No. 1-4 Ohnemus, located in the NW1/4 SE1/4 Section 4, Township 33 South, Range 7 West, N.M.P.M., La Plata County, Colorado to be used as a disposal well for water from the Fruitland Coal Seam wells into the Mesaverde formation.

 

IT IS FURTHER ORDERED, that all operations of the well as a disposal well shall be in accordance with Rule Nos. 326 and 327 of the Rules and Regulations of the Commission.

 

IT IS FURTHER ORDERED, that the provisions contained in the above orders shall become effective forthwith.
