REPORT OF THE COMMISSION
This cause came on for hearing before the Commission on December 17, 1968, at 10 a.m., in Conference Room 260, Columbine Building, 1845 Sherman Street, Denver, Colorado, after publication of Notice of Hearing and proper service thereof, as required by law and the rules and regulations of the Commission, on the application of Pan American Petroleum Corporation for an exception to said established spacing pattern to produce gas from the Mesaverde formation from a well located 670 feet from the South line and 300 feet from the West line of Section 8, Township 33 North, Range 7 West, N.M.P.M., La Plata County.
FINDINGS
The Commission finds as follows:
1. That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.
2. That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.
3. That testimony presented at the hearing indicates that a well drilled at this location for production from the Dakota-Morrison formation proved to be non-commercial, but that the Mesaverde formation is commercial and in order to avoid unnecessary drilling and to increase the ultimate recovery of gas from this formation, the application should be approved as being in the public interest for conservation.
4. Since there is commercial production from the Mesaverde formation for a well drilled on the location set forth above, instead of on a location as provided by said Order No. 112-6, the Commission should, upon application of any interested party and after notice and hearing, take such action as will offset any advantage the operator of such exception may have over other producers by the production from such a well located as an exception to the established spacing pattern.
ORDER
NOW, THEREFORE, IT IS ORDERED, that an exception is hereby granted for a well located 670 feet from the South line and 300 feet from the West line of Section 8, Township 33 North, Range 7 West, N.M.P.M., La Plata County, for production of gas from the Mesaverde formation, and the Commission shall, at the request of interested persons, and after notice and hearing, take such action as will offset any advantage the operator of such an exception may have over other producers by reason of the well drilled as an exception.
IT IS FURTHER ORDERED, that the provisions contained in the above order shall become effective herewith.
