CAUSE NO. 112
ORDER NO. 112-22 |
REPORT OF THE COMMISSION
This cause came on for hearing before the Commission on August 20, 1963, at 10 a.m., in Room 132, State Services Building, Denver, Colorado, after publication of Notice of Hearing and receipt of Waivers of Service as required by law and the rules and regulations of the Commission, on the application of Tex-Star Oil & Gas Corp. for an order authorizing, as an exception to the spacing pattern established by Order No. 112-6, the location of a well to be drilled 1320 feet from the north line and 1650 feet from the west line of Section 2, Township 32 North, Range 7 West, N.M.P.M., La Plata County, Colorado; and designating the W˝ of said Section 2 as the drilling unit for the Mesaverde formation.
FINDINGS
The Commission finds as follows:
1. That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.
2. That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.
3. That testimony presented indicates that a well located 1320 feet from the north line and 1650 feet from the west line of Section 2, Township 32 North, Range 7 West, N.M.P.M., La Plata County, Colorado, would be more productive than a well located in conformance with the spacing pattern established by Order No. 112-6; and that the W˝ of said Section 2 should be designated as the drilling unit for production of gas from the Mesaverde formation.
4. That Applicant was unable to secure waivers or consents in writing from all owners of contiguous and cornering 320-acre tracts adjacent to the W˝ of said Section 2.
5. That no owner will be adversely affected by reason of the granting of the above exception.
6. That at the hearing no appearance was made in opposition to Applicant's request.
ORDER
NOW, THEREFORE, IT IS ORDERED, that the W˝ of Section 2, Township 32 North, Range 7 West, N.M.P.M., La Plata County, Colorado, shall be the designated drilling unit for production of gas from the Mesaverde formation; and an exception to the spacing pattern established by Order No. 112-6, insofar as it pertains to production of gas from the Mesaverde formation, is hereby allowed for a well to be drilled 1320 feet from the north line and 1650 feet from the west line of said Section 2; and said well shall be the permitted well for the drilling unit upon which it is located.
ORDERED this 20th day of August 1963.
