ORDER NO. 112-20

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on February 19, 1963, at 10 a.m., in Room 330, State Office Building, Denver, Colorado, after publication of Notice of Hearing and receipt of Waivers of Service as required by law and the rules and regulations of the Commission, on the application of The Atlantic Refining Company for an order authorizing, as an exception to the spacing pattern established by Order No. 112-6 for the Dakota formation, the location of its Southern Ute Tribal Well No. 15-1, 32-10, located 1090 feet south of the north line and 1760 feet west of the east line of the NEĽ of Section 15, Township 32 North, Range 10 West, N.M.P.M., La Plata County, Colorado.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3.      That testimony presented indicates that Applicant's Southern Ute Tribal Well No. 15-1, 32-10, located 1090 feet south of the north line and 1760 feet west of the east line of the NEĽ of Section 15, Township 32 North, Range 10 West, N.M.P.M., La Plata County, Colorado, previously drilled to the Mesaverde formation, is capable of producing from the Dakota formation.

 

4.      That in order to prevent the drilling of unnecessary wells, an exception to the established spacing pattern for the Dakota formation should be granted for completion of said well in the Dakota formation.

 

ORDER

NOW, THEREFORE, IT IS ORDERED that an exception to the spacing pattern established by Order No. 112-6 is hereby allowed for The Atlantic Refining Company's Southern Ute Tribal Well No. 15-1, 32-10, located 1090 feet south of the north line and 1760 feet west of the east line of the NEĽ of Section 15, Township 32 North, Range 10 West, N.M.P.M., La Plata County, Colorado, in order that said well may be completed in the Dakota formation.
